re: Amigos restaurant and drive -through PUD submission of 1991
Dear Ms. Whetstone:
Several months ago Ft. Collins Assemblage, Ltd. initiated an
application for PUD approval for an AMIGO's Restaurant and
Drive- Thru facility to be located on the southeast corner of
the intersection of South College Avenue and proposed Kensington
Drive. That request for approval was appropriately considered
by the staff of the various City departments and was not
approved, principally because the required Kensington right of
way was unavailable. Since the date of the letter from P and Z
setting forth the required conditions for approval no further
activity or re -submission has been attempted by the proposed
developer Ft. Collins Assemblage, Ltd.
As of last Wednesday, February 26, 1992, George Holter, the
contiguous property holder, informed me that he proposes to
build and lease the proposed improvements of Amigos Restaurant
and Drive-Thru on his property located north of proposed
Kensington Drive.
He solicited my cooperation as a neighboring landowner in the
proposed PUD and asked for permission to utilize the engineer-
ing studies, traffic reports, and other planning concepts that
had been incorporated in my previous submission. He also
requested my cooperation in a "fast track" PUD submission. I
responded that on behalf of the landowner I would recommend full
cooperation with the City of Fort Collins and with George Holter
in the proposed PUD for Amigos Restaurant and Drive-Thru.
Much earlier, Mr Robert Pennock, of Coldwell Banker/
Everitt -Williams, the real estate agent for Ft. Collins
Assemblage, Ltd., had discussed the proposed relocation of
Amigos to the Holter property with George Holter and me. The
consideration to Fort Collins Assemblge, Ltd. was to be the
assumption by George holter of the existing unpaid planning and

professional fees to Vaught/Frye Ar`-cciitects, assmump ion of the
unpaid Parsons Engineering fees, as well as reimbursement of
other out of pocket expenses by Fort Collins Assemblage, Ltd. in
the agreed amount of $2,430.
This letter is to inform the City of Fort Collins Planning and
Zoning Department of my desire to withdraw the pending Amigos
PUD and to communicate my willingness to staff to cooperate
fully with George Holter in the proposed Amigos re -location to
his property.
on Friday, February 28, 1992, Mike Henniger, property specialist
from the Amigos home office discussed with me my intent as a
contiguous property owner. I fully informed him of my previous
agree.,,a,-.t and understanding with George Holter through the
agent, Bob Pennock, and assured him that my owners would be
cooperative in all reasonable requests and accomodations.
This letter is to confirm in writing my understanding and
agreement and my willingness to cooperate reasonably in the
extension of Kensington Drive and in the PUD approval process
for an Amigos facility at that location.
I will be available for meetings, plan approval and the usual
and customary contiguous owner input as the proposed PUD is
prepared and submitted to your office for the approval process.
