STATEMENT OF OWNERSHIP SUBDMSION DEDICATION AND DECLARATION OF
PROTECTIVE
Know all men by these presents: that the undersigned, being the
owner(s) and proprietors of the following described land, to —wit:
A tract of land located in the Southeast Quarter of Section 31
Township 7 North, Range 68 West of the Sixth Principal
Meridian, City of Fort Collins, Lorimer County, Colorado,
being more particularly described as follows;
Considering the line between the southeast comer of the said
Section 31, being a found No. 5 rebar, and the east quarter
comer of the said section 31, being a found brass cap in a
range box, being the east line of the said southeast quarter
of section 31, as bearing North OOo12'00" West, as shown on
the recorded subdivision of Harmony Half Acres, a Plat of
record with the Clerk and Recorder of the said Lorimer County,
and with all bearings contained herein relative thereto;
Commencing at the said southeast comer of section 31, thence
along the said east line, North OOo12'OCl West 1328.69 feet to
the northeast comer of the said plat of Harmony Half Acres;
thence along the north boundary of the said plat as now
monumented by LS 4502 No. 4 rebor and plastic caps, North
83o48'55" West 30.19 feet to the existing westerly right—of—
way of Timberline Road, being a line which is 30.00 feet
(measured at right angels) west of and parallel with the said
east line of the southeast quarter of section 31 and to the
TRUE POINT OF BEGINNING of this description; thence continuing
along the said north boundary of the plat as now monumented,
the following four (4) courses and distances, (1) North
83o48'55' West 71.45 feet; (2) North 70o43'44 West 380.63
feet; (3) North 62o4O'O4" West 388.55 feet; (4) North
38o12'41" West 135.18 feet; thence continuing along the said
north boundary as now monumented and its westerly
prolongation, North 69o15'1f West 184.97 feet to the east
right—of—way of the Union Pacific Railroad; thence along the
acid railroad right—of—way, North OOo13'41" West 258.46 feet;
thence leaving the said right—of—way, South 82oO2'59"East
South 64oO6'21' East 279.45 feet; thence South 74o15'21" East
294.97 feet to the said existing westerly right—of—way of
Timberline Road; thence along the said right—of—way, South
OOo12'00" East 454.33 feet to the point of beginning.
Containing 9.834 acres or 428373 square feet more or less have
caused the some to be surveyed and subdivided into a lot, and a
street as shown on this plat to be known as PLAT OF THE TIMBERLINE
WETLAND and is subject to all easements and rights —of —way now on
record or existing or indicated on this plat and does hereby
dedicate and convey to and for public use, forever hereafter, the
streets and easements as laid out and designated on this plat,
provided however, that: (1) acceptance by the City of this
dedication of easements does not impose upon the City a duty to
maintain the easement so dedicated, and (2) acceptance by the City
of this dedication of streets does not impose upon the City a duty
to maintain the streets so dedicated until such time as the streets
are inspected and accepted by the City Engineer.
