RE: Paragon Point, Phase 2, Final P.U.D.
Dear Ted:
Jim Sell Design, on behalf of the Owner, is submitting the revised
Final P.U.D. with the following changes, made in response to the
comments from staff review (numbering corresponds to that in your
letter of September 18).
6. There is a utility easement across the west side of Lot 34
shown on the Final Site Plan. The easement has been added to
the plat, as well.
7A. This issue was discussed the during the site visit attended by
Rob Wilkinson, Jim Sell and yourself. When in the field it
was obvious that the rock outcrops in question are far less
significant than those at the north end of the site (Phase 1) and
don't offer good perching sites; therefore, it was agreed at that
time that these outcrops needn't be included in the conserva-
tion easement. Also, it is useful to recall that another reason
for these easements, not indicated on the plan but discussed
initially, was to prevent soil erosion adjacent to Fossil Creek
on steep slopes in Filing 1, a condition which does not occur
in this tiling.
The conservation easement has been modified on the west
edges of Lots 14 and 15, where adjustment was necessary to
provide an adequate building envelope.
7B. The area which is will be disturbed by construction is delin-
eated on the construction plans prepared by TST.

The seed mix we are using is that indicated in the management
plan report. It includes the species listed on the mix recom-
mended by Staff, except for Indian Yellowgrass, as well as
additional forbs identified in the field as valuable for use in the
break areas. A copy of the seed mix used on Phase One and
planned for Phase Two is attached.
Disturbed areas will be reclaimed by drill seeding with the
mixtures indicated above; slopes greater than 3:1 will be mulch
with crimped -in, clean, dry straw mulch.
7C. The Owner prefers planting an additional 34" caliper tree in
the vicinity of the lower pond to relocating the dead trees from
the east side.
7D. The conservation easement is not shown on Lots 17-20 because
there are no significant rock outcrops which would require
protection.
7E. Reclamation for Phase One is currently underway.
8. Building on the double -frontage on Lots 23, 24 and 25 will be
required to orient toward Falcon Ridge Court.
9. The note has been changed.
10. This is already covered in Project Note #10.
11. The trail easement is in Tract C and not within the boundary
of this filing.
12. The boundary of this filing is the northern and western bound-
ary of Tract C.
13. Autumn Purple Ash was approved for use along Lemay Ave-
nue as a street tree and is used again on Trilby in the interest
of consistency.

Ted, I believe this addresses the planning and landscape issues for
Phase Two. Engineering issues are being addressed by TST. If you
