This is in response to your letter to City Manager Steve Burkett
regarding the Paragon Point Planned Unit Development in Fort
Collins, Colorado.
Mr. Burkett forwarded your letter to me for response; the City
departments reviewing the Paragon Point Planned United Development
application fall under my supervision.
The Paragon Point application has required evaluation of several
competing policy objectives contained in City of Fort Collins
ordinances and planning documents. As you note in your letter, the
Planning and Zoning Board has reviewed the final approval
application, and has delayed action until their meeting of March
23, 1992. Between the February and March meetings of the Planning
& Zoning Board, the applicant is working with the City staff to
prepare the habitat management plan referenced in your letter.
---That plan was submitted today for our review.
This management plan relates primarily to the character of the open
space within the proposed planned unit development. To my
knowledge, there has never been significant disagreement about the
residential or commercial development proposed to be built on the
other portions of the site.
I assure you that competent, staff members are working with the
developer to address the issues that have been raised by this
development proposal. We will continue to make every effort to
balance the competing interests of all parties involved and to
fashion an equitable solution to the problems presented by the
application of the City's land use regulations to this particular
parcel of property.

Dear Mr. Burkett:
Lutheran Church Extension Fund -Missouri Synod ("LCEF") is the owner of
record on the above referenced parcel. July 2, 1991 LCEF entered into an
agreement to sell subject property to Byron R. Collins, Developer. The
buyer's obligation to perform under the agreement is conditioned upon the
U buyer's ability to obtain or have approved a P.U.D. acceptable to the
buyer. The Agreement further provides for seller financing over an
FA extended period of time.
Mr. Roger Pranzlow of Associated Brokers - Ft. Collins, Colorado is the
LCEF representative for the sale and development of the property. Mr.
Prenzlow together with Mr. John Huisjen, Attorney representing the LCEF,
have been continuously keeping our office apprised of the progress made
with the city to obtain final approval of the proposed development. The
history of the dealings between the City of Ft.. Collins and the LCEF is
one that is a continued concern. As we near completion of the first phase
- -----of-this-development, we respectfully request that you and your-staff--treat-
this project, the developers and the LCEF with fairness in regards to all
of the outstanding issues which yet need to be resolved.
.Final approval of the first phase of Paragon Point P.U.D. has been delayed
to a Planning 3 Zoning Board meeting on March 23, 1992. It is our
understanding that the developer must furnish to the city on or before
March 12, 1992 completed doouments for final approval. One of the
documents of significance is a habitat management plan for the
development. Over the past several months there has been a growing level
of mistrust of the city staff regarding wildlife habitat issues. From
LCEF's standpoint many of the habitat. issues for Paragon Point will
continue to be significant issues for the LCEF whether or not the Paragon
Point Development proceeds to approval.

Byron Collins, Developer/Applicant for approval for Paragon P.U.D, to the
lead partner in the entity known as Paragon Point Partners, a Colorado
limited partnership. Mr. Collins and the Paragon Point Partners are the
persons responsible to work out the development agreement and obtain
approval from the City of Ft. Collins. It is our, understanding that they
will submit a habitat management plan for the development which
incorporates the features of their development plan and provide a balanced
environmental approach to the habitat management of the property with
significant water features, re -vegetation of the soil, establishment and
protection of the Fossil Creek stream bed and the maintenance of a
stabilized environment offering the greatest protection of the natural
resources which are available on that site. In the event that Mr. Collins
and his partners are unsuccessful in reaching resolution of this matter
with the City of Ft. Collins, the LCEF will be prepared to move forward
with an alternative plan for the maintenance of the property within its
historical agricultural context.
The Paragon Point Planned Unit Development has reached a critical
juncture. Either agreement will be reached so that a program of
development may be followed which will provide substantial benefits for
the oommunity and for the city as a whole or failing that,'the land will
be restored to its former use as irrigated pasture landa and related
agricultural uses. In the event that the development is not approved, the
land will be returned to a more agricultural -based environment with a loss
of a valuable development opportunity which is promised upon annexation.
Please provide your assistance in resolving this matter so that we may
achieve the greatest good for our concern. I urge your cooperation as
well as the full cooperation of your staff to ensure that competency and
fairness are re-established in the planning of Paragon Point and the
balance of the property.
