RE: Application for a Modification
in the Huibregtse Property Plat
Dear Mr. Shephard (or any concerned landowner):
Per your request, I am writing this letter outlining the reasons why Mr. and Mrs. Huibregtse have
filed an application with your office to modify the plat of the Paragon Point subdivision concerning
the property at 6430 Falcon Ridge Court, in the city of Fort Collins. Currently, the property is the
home of Mr. and Mrs. Huibregste. A little more than a year ago, Mrs. Huibregtse developed a
serious medical condition which left her seriously handicapped. The driveway at the Huibregtse
home located on Falcon Ridge Court is on a steep incline. Soon after Mrs. Huibregtse became
handicapped, they quickly realized that it was dangerous for her to use their existing driveway.
Adjacent to the Huibregtse's house is was a driveway which extends along the length of their home
toward the rear of the property. Mr. Huibregtse extended the existing driveway several feet so they
were able to enter their property from Southridge Greens Boulevard. When Mr. Huibregtse extended
the driveway to Southridge Greens Boulevard he had no intention of breaking any rules or city
ordinances, he only wanted his wife to be able to have safe access to their home.
Concerns about this new access driveway were brought to the Huibregste's attention by both the
Paragon Point Homeowners Association and the City of Fort Collins. The concern is the Huibregtse
property plat, registered with the county and approved by the city includes a note which states that
this property shall not have access to Southridge Greens Boulevard.
Trying to alleviate any problems, and still wanting his wife to have safe access to her own home,
Mr. Huibregtse, with the help of the City of Fort Collins Commission on Disability, was told to

apply to your office for what would be classified as a small project. This project would be a replat
of the Huibregtse property, which would allow the current driveway to remain as long as Mrs.
Huibregtse's medical situation remains. Further, if the Huibregtse's ever sell the property or if Mrs.
Huibregtse medical condition improves such that the access is no longer required, the access
privilege will terminate and the driveway will be removed.
We do understand that to keep within current regulations, all property owners within 500 feet of the
Huibregtse property must be notified of the proposed change before the Current Planning
Commission would be able to make the change.
