Box 272349 Fort Collins, CO 80527 Dear Mr. Deal: The purpose of this letter is to respond to your request for information regarding building out Paragon Point P.U.D., 5th Filing. There are two proposed scenarios. One is to reduce the number of lots from 20 to 19 and reconfigure several of the side lot lines. The second scenario is to retain 20 lots but still reconfigure the side lot lines. Under the first scenario, a Replat would be required to reduce the number of lots and reconfigure side lot lines. The P.U.D. Site Plan would also have to be amended to reduce the number of lots. This would be considered a "Major Amendment" because the reduction in the number of lots exceeds 1%. (The loss of one lot represents a 5% reduction.) A Major Amendment must be forwarded to the Planning and Zoning Board for consideration. The Major Amendment would. be reviewed by the former code, the Land Development Guidance System (L.D.G.S.). Garage placement standards of the new Land Use Code would not apply. Under the second scenario, a Replat is still required due to the proposed reconfiguration of the side lot lines. The P.U.D. Site Plan would be amended administratively as a "Minor Amendment" and would not.have to go the Planning and Zoning Board. The Replat would be reviewed by the Planning Director in an Administrative Review. The Minor Amendment -would - be reviewed by the Land Development Guidance System (L.D.G.S.) in conjunction with the Replat. For your information, the reduction of one lot does not place Paragon Point P.U.D. in its entireity or just the 5th Filing, below the mandated (by the L.D.G.S.) minimum of 3.00 dwelling units per acre.
