Hair Community Construction, Inc. 531 California Avenue Bakersfield, California 93304 Re: Mountainridge P.U.D., Regional Detention Ponds Dear Steve: We have completed our review of the Mountainridge P.U.D. Groundwater Study prepared by Empire Laboratories. We feel that several issues that were required in the original scope have not been adequately addressed, so we will be returning the report to Empire for revisions and resubmittal. A copy of our comments has been attached for your reference. In the meantime, I have set up a meeting with the design consultant, RBD, Inc. to discuss the results of the groundwater study and how it will affect the design of our regional ponds. This meeting will take place on Tuesday, February 9. Based on your letter of January 25, 1993, 1 believe there has been a misunderstanding as to how this project will proceed. In our phone conversation on the 25th I said that I would treat the report submittal as if it were being submitted for the March Planning and Zoning Board meeting, meaning I would meet the review schedule. However, I will not be submitting anything to the Planning Department for their review. The results of this study are to be incorporated into the final design of the regional detention ponds. Therefore, any changes to the regional pond shown on the utility plans for the First Filing of Mountainridge will be made by RBD, Inc. and submitted to Planning as revisions. As with any submittal to the P&Z Board, meeting the initial submittal date only places you tentatively on the schedule. We understand that there is only limited time to do any work on the Pleasant Valley and Lake Canal prior to the start of the irrigation season April 15, however, as we told you last summer there has never been any guarantee by the Utility that we would be able to resolve this issue prior to that deadline, or that we would even be able to afford to implement the required improvements in 1993. After the report is revised and we have met with RBD, we will be able to identify how we will proceed and what options you will have to proceed with the First Filing. 233 Mathews • P.O.
