PROJECT DESCRIPTION:
This is a request for a Replat of Lot 19 of block 2, Evergreen Park Residential
Subdivision, Second Filing for the purpose dividing one large lot into two smaller
lots. The lot is at the corner of Foxtail Street and Monterey Drive and is located in
the existing Evergreen Park, Second Filing residential development that is west
of North Lemma Avenue and north of Conifer Street. Lot 19 of Block 2 is in the in
the RL - Low Density Residential Zoning District.
RECOMMENDATION: Approval
EXECUTIVE SUMMARY:
This request to replat Lot 19 of the Evergreen Park Residential Subdivision,
Second Filing complies with the applicable requirements of the Land Use Code
LUC , specifically the procedural requirements located in Division 2.1 - General
Procedural Requirements, Division 2.2 - Common Development Review
Procedures for Development Applications, and Division 2.4 - Project
Development Plan located in Article 2 - Administration; and Section 3.3.1 - Plat
Standards located in Article 3 - General Development Standards.

COMMENTS:
1. Background:
The zoning and land uses that surround the Evergreen Park Residential
Subdivision, Second Filing are as follows:
N: RL; existing residential (Greenbriar PUD)
S: LMN; existing and planned residential (Evergreen Park, 3rd Filing)
W: LMN & RL; existing residential (Nokomis Subdivision, Greenbriar Village
PUD, 3rd Filing)
E: UE & County FA1 Farming; existing residential and farming (Lindenmeier
Subdivision, farmland)
This property was annexed into the City as part of the "Evergreen Park
Annexation and Zoning Plat to the City of Fort Collins" on December 20, 1973.
The original plat of Evergreen Park, second filing was approved by the P&Z
Board on December 2, 1976. There was a replat of Evergreen Park, second
filing approved by the city council on June 7, 1977.
The replat of Evergreen Park, Second Filing residential neighborhood is a 71.39
acre development comprised of 7 platted "blocks" which make of total of 172
lots. Lot 19 of block 2 is 24,773 square feet, and shares frontage of the cul-de-
sac portion of Monterey Drive with lots 20 through 24 of block.
The lots on the cul-de-sac portion of Monterey Drive currently range in size from
16,729 to 28,185 square feet. Lots 17 and 18 of block 2 are directly to the west
of this lot, and share a common rear property line with lot 19. Lots 17 &18 are
9,672 and 12,080 square feet respectfully. Both Lot 17 and lot 18 front onto
Coulter Street.
2. Purpose of the Replat:
The purpose of the Replat of Lot 19 in Block 2 in the Replat of Evergreen Park,
Second Filing is to reconfigure the one 24,773 square foot lot into two lots
13,090 and 11,683 square feet in area. Staff has determined that there is no
detriment to the approved development plan associated with the replatting of this
lot.

3. Article 2 - Administration:
The REPLAT OF LOT 19 IN BLOCK TWO OF THE REPLAT OF EVERGREEN
PARK SECOND FILING complies with the applicable requirements of the LUC,
specifically the procedural requirements located in Division 2.1 - General
Procedural Requirements, Division 2.2 - Common Development Review
Procedures for Development Applications, and Section 2.4 - Project
Development Plan located in Article 2 - Administration.
4. Article 3 - General Development Standards:
The REPLAT OF LOT 19 IN BLOCK TWO OF THE REPLAT OF EVERGREEN
PARK SECOND FILING complies with the applicable requirements of the LUC,
specifically the plat requirements located in Section 3.3.1 - Plat Standards
located in Article 3 - General Development Standards.
A. The replat is in compliance with Section 3.3.1(A) General Provisions in
that:
1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in
writing on the plat and signed by the City Clerk.
2) No building permit or certificate of occupancy shall be issued for
construction of any new principal building or no act which changes the
use of any building shall be permitted until the subdivision plat is filed
and recorded in the City of Fort Collins.
B. The replat is in compliance with Section 3.3.1(B) Lots in that:
1) Each lot is at least 6,000 square feet in size, as set forth in Division 4.3
RL - Low Density Residential Zoning District, each lot has direct
vehicular access to a public street (Monterey Drive), and the side lot
lines are substantially at right angles or radial to the street lines.
2) The general layout of lots, roads, driveways, utilities, drainage facilities
and other services within the proposed development were established
with the approval, filing, and recording of the Evergreen Park, Second
Filing subdivision replat. This replat to divide lot 19 of block two into 2
separate lots will not change the currently platted utility and drainage
easements. The design of the platted road (Monterey Drive) is
unaffected.

C. The replat is in compliance with Section 3.3.1(C) Public Sites,
Reservations and Dedications in that:
1) An applicant shall be required to dedicate rights -of way for public
streets, drainage easements and utility easements as needed to serve
the area being platted. The right-of-way for Monterey Drive and the
drainage and utility easements necessary to serve this area were
dedicated with the Replat of Evergreen Park, Second Filing subdivision
plat that is on record in the City of Fort Collins. The replat of lot 19 in
block two does not eliminate the necessary dedications.
2) Reservation of sites for flood control, open space and other municipal
uses shall be made in accordance with the requirements of this Land
Use Code. This criteria is not applicable to the REPLAT OF LOT 19 IN
BLOCK TWO OF THE REPLAT OF EVERGREEN PARK SECOND
FILING request.
5. Findings of Fact/Conclusion:
A. The REPLAT OF LOT 19 IN BLOCK TWO OF THE REPLAT OF
EVERGREEN PARK SECOND FILING contains a permitted use in the RL
- Low Density Residential Zoning District.
B. The REPLAT OF LOT 19 IN BLOCK TWO OF THE REPLAT OF
EVERGREEN PARK SECOND FILING meets the procedural
requirements located in Division 2.1 - General Procedural Requirements,
Division 2.2 - Common Development Review Procedures for Development
Applications, and Section 2.4 - Project Development Plan located in
Article 2 - Administration.
C. The REPLAT OF LOT 19 IN BLOCK TWO OF THE REPLAT OF
EVERGREEN PARK SECOND FILING meets the plat requirements
located in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.
RECOMMENDATION:
Staff recommends approval of the REPLAT OF LOT 19 IN BLOCK TWO OF THE
REPLAT OF EVERGREEN PARK SECOND FILING.
