Evergreen Park, 2" Filing. There are only a few minor changes that need to be incorporated to the project in order for staff to recommend approval. Water and Sewer Utility Department: a. On sheet 3 of 3 on your Utility & Lot Grading Plan, the water main on Foxtail — _ Street needs to be labeled as "existing 6" water main." b. On sheet 3 of 3, another sentence needs to be added to the general note: which reads, "Water lines shall maintain 4.5 feet minimum to 5.5feet maximum depth of bury measured from finish grade." 2. Stormwater Utility Department: a. Based on a site visit, the sidewalk in the southwest corner of Lot 19B appears to be higher than the area north of the sidewalk. Please take measures to prevent ponding behind the sidewalk. 3. Engineering Department: a. Any street. cuts to provide services to said lots will require a street cut permit and shall be subject to all applicable fees and requirements. b. On sheet 3 of 3, there is a comment that starts, "cut and replace pavement...." ; The last phrase of that comment which states "as required by the engineering 281 North College Avenue • PO. Light and Power: a. Modifications to the electric system required to provide electrical service to the additional lot will be at owner's expense. The public hearing for this project has been scheduled at 1:30 pm Tuesday, March 9,. 1999 in conference room B at 281 N. College Avenue. These changes should be made to the utility plans and resubmitted to Troy Jones in the Current Planning office no later than 5pm on Friday, March 5, 1999. You may be interested to know that concerned citizen came to look at the file and mentioned that there may be restrictive covenants in the neighborhood prohibiting you from subdividing your lot. This, however, does not affect your application with the City of Fort Collins, and would be a civil matter between you and any party wishing to enforce such covenants. As far as your application with us is concerned, we will review it only for compliance with the Land Use Code. Provided that you address the staff concerns listed above, we feel that your application complies with the Land Use Code, and will be recommending approval of your replat at the public hearing.
