SUBJECT:
Resolution 97-73 Stating the Intent of the City of Fort Collins to Annex Certain Property and
Initiating Annexation Proceedings for Such Property to Be Known as the K-2 Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.

EXECUTIVE SUMMARY:
The property being considered for annexation has, for a period of not less than three (3) years, been
completely surrounded by property contained within the boundaries of the City of Fort Collins. The
property being considered for annexation is approximately 29.7 acres in size and is located east of
I-25, 1/4 mile north of Vine Drive and south of the Larimer and Weld Canal. The property is
currently used for a wholesale distribution business, boat and RV storage, and agricultural feed sales
on three separate parcels of land. The proposed zoning for this annexation is I - Industrial.
The proposed Resolution states that it is the City's intent to annex this enclave property and directs
that the published notice required by State law be given of the Council meeting to consider the
needed annexation ordinance. The time of First Reading of the annexation and zoning ordinances
is scheduled for July 1, 1997. Not less than thirty days prior published notice is required by State
law.
BACKGROUND:
The property is located within the Fort Collins Urban Growth Area (UGA). According to policies
and agreements between the City of Fort Collins and Larimer County contained in the
Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will agree to
consider annexation of property in the UGA when the property is eligible for annexation according
to state law. The property became completely surrounded by the City of Fort Collins through the
following annexations:
N: Buckeye Farms, Inc. And Harold D. Einarsen Annexation - October 18, 1988
E: Buckeye Farms, Inc. And Harold D. Einarsen Annexation - October 18, 1988
S: Front Range Farms II Annexation - January 19, 1988
W: Allen, Lind, Moore Annexation -February 21, 1984
The property became eligible for annexation as an enclave on October 18, 1991.

I am writing regarding the R-2 annexation hearing
planned for April and July 1997. This will be the third
time I have had to present myself to try to retain some
little bit of sovereignty over property that was purchased
with my money and as a result of my hard work.
I know that for many of you, your only chance to show
authority (govern) is your council or board seat, and it
probably seems right and proper to annex everything on the
map that isn't the proper color. After all, it will make
for a cleaner, more contiguous city if everything is within
certain boundaries. Well, then considering this annexation,
please bear in mind what one of our founding fathers said,
(I think it was James Madison). "The government that governs
least, governs best." So I ask you to please use a little
bit of wisdom and common sense when making this annexation
decision.
The property in question is already under the control
and rule of three levels of government: Federal, State and
County. In addition to this, add several autonomous
bureaucracies which do not seem to be reporting to any
elected officials.
Your push to annex every enclave seems to be misguided
at best. The state law under which you are using to do this,
was devised to take care of troublesome areas in close
proximity and non-conformtng= to existing and larger areas.
(This per deceased State Senator Ron Strahle). In the
case of R-2, it is surrounded by previously annexed property;
it is a stretch of definition to say it is part of the city
since there has been absolutely no development on any of the
surrounding properties. There is still no city input in
terms of infra -structure to any of these properties. As
far as I know now these properties are still all zoned
agricultural, which means city revenue generated is-JJjmited
at best.

It seems to me that rather than tinkering with small
parcels 6� miles from City Hall, you could all use your
public service time to a better advantage by solving the
infill problems of the east, north-east and north-west
rf development were moved in an orderlv manner from Center
out• you wouldn't have the problem or the costly impact of
brinaincs the infra -structure to remote annexatiions-
At best, annexation seems like a one sided deal where
the city should reap qreat benefits in taxes and other
revenues with the three businesses involved netting nothing
in return. However• the facts are that two of the businesses
involved are selling their products out of the area7(no city
tax) The third business is a start up business operating
at a very low dollar volume (very little tax). T'm sure
that by the time the city installs the mandatory electrical
equipment and sends out police protection, you will be
ooerating at a net revenue loss for many• many years -
To put this situation in the simplest terms I possily
can• I will sav I object to annexation because:
1_ Increased burden on businesses to comply with a
new set of rules and regulations.
2. Forcing these businesses into charging a 5 or 6
percent higher prices than competitive businesses
closer to city.
3. Increased property tax.
4. Sales tax.
5. Telephone tax.
6. Storm water tax.
7. Decreased security.
8. Increase in building permit prices
9. Conflict with proposed zoning.
So ladies and gentlemen if you truly are committed
to your public service, and committed to governing; your
decision to annex will be NO.

Ladies and Gentlemen:
Fort Collins is an ideal place to live, but does Fort
Collins want to right size or down size? This is only a
question the board can answer with a yes or no vote.
Right size.
We were planing to expand the operation with more trucks and
more mechanics. This means more jobs for the local economy.
Right size!!!
More trucks means we will purchase more parts from the local
parts stores, more business means more office supplies and
cleaning supplies will be needed. We will also add more
trees and shrubbery and flowers to our area which means more
gardening supplies.
we purchase anywhere from 2 to 4 thousand dollars per truck
in parts and labor per month. Averaging 24,000 dollars per
year per truck.
We have 14.5 acres which we farm 12 acres, this property
also has lease hunting rights.
Down size
If we are forced into the city what happens?
We will not be able to expand do to the following:
The taxes on new trucks and equipment purchased. Costing us
an additional $45,000.00 per year.

The extra city tax charged would run about 1,872.00 per year
per truck on parts alone.
We loose the lease hunting rights for our property.
We already pay city tax on purchases on office supplies,,
cleaning supplies and gardening supplies so there would be
no change for either side.
Loss of customers. If our cost go up so must the consumers.
The consumers that we serve are already feeling the squeeze
in more ways than one and we will not be apart of it.
What do we get in return from the city? As far as I can see
NONE. If the.surrounding area was incorporated into the
city in 1988 what improvements have been made?
What does the city get if we are incorporated.
Loss of Jobs, Loss of revenue, Loss of business in downtown
area, and loss of respect.
We will move our operations into Weld Co.
Weld Co. and the Greeley Area will reap the rewards of not
only the business mentioned above, but we also have people
in from California 2 and 3 times a month, which means out of
town money spent at hotels and motels, eating out and car
rental. Not to mention the money spent at gift shops in old
town, which we always recommend our guest visit.
In moving to Weld Co. we can feel good about keeping our
prices down for our farmers and ranchers that use our
product. As you see there are only 2%.of the U.S.
population that is providing the food that goes on your
table everyday and the number is decreasing steadily. In
the last year alone we have seen at least 5 farms and
dairies sellout as they could not make it do to high costs.
If people are forced to increase prices as we would because
of city taxes it only hurts the economy in the long run and
may even raise the cost of your food bill in the future.

Larimer County has reviewed the proposed K-2 Annexation and Rezoning and
recommends approval of this project.
This property is an enclave of County property that is surrounded by the City
limits. The Intergovernmental Agreement for the Fort Collins Urban Growth Area
indicates that it is desirable for the City to consider annexing all the enclaves.
Taking these isolated parcels into the City will help avoid jurisdictional problems
in the future.
It is not clear from the reduced copy of the plat if all the right of way for 1-25 and
the frontage road is being annexed although the A. I. R. indicates that all right of
way is included. If all the public right of way adjacent to this site is annexed
there will be no negative impacts on County facilities or services.

Planninz and Zoning Board Recommendation
The Planning and Zoning Board conducted a public hearing on the annexation and zoning request
at its continued meeting on April 14, 1997. The Board recommended that the Council deny this
annexation by a vote of 3-0 with one abstention. The recommendation for denial was based on the
Board's observations that this property is on the fringe of the City limits and Urban Growth Area
and that there has been no growth pressures in this area indicated by nearby development
applications.

ANNEXATION IMPACT REPORT
NAME OF ANNEXATION:
K-2 Annexation.
DATE OF REVIEW BY THE FORT COLLINS CITY COUNCIL:
July 1, 1997 and July 15, 1997
The purpose of this report is to satisfy the requirements of CRS
31-12-108.5 which indicates a municipality shall prepare an
annexation impact report and file a copy of the report with the
Board of County Commissioners governing the area proposed to be
annexed. Attached to this report are the following:
(aI) A map showing the present and proposed boundaries of the City
of Fort Collins in the vicinity of the above referenced annexation.
The proposed boundaries of the City of Fort Collins are depicted by
the Urban Growth Area boundary as agreed to by the Larimer County
Board of Commissioners and the Council of the City of Fort Collins
and contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT
COLLINS URBAN GROWTH AREA. (See Exhibit A).
(aII) A map showing present streets, major water trunk lines, sewer
interceptors and outfalls, other utility lines and ditches, and the
proposed extension of such streets and utility lines in the
vicinity of the above referenced annexation. (See, Fort Collins
Urban Growth Area Master Street Plan for present and proposed
extension of streets; Water Master Plan 1986 for present and
proposed extension of water utility lines; Sewer Master Plan 1986
for present and proposed extension of sewer utility lines; and
Exhibit B for other utility lines and ditches).
(aIII) The area of the proposed annexation includes wholesale
distribution business, two buildings being used for boat and RV
storage, and agricultural feed sales on three separate parcels.
Parcel one is owned by HUB Enterprises, which uses the existing
building for office, assembly and warehouse space for a wholesale
distribution business. Parcel two is owned by Frank A. Just and
contains the boat and RV storage use_ Parcel three is owned by the
A. L. Gilbert Company and the building on this parcel is occupied
by Fort Collins Feed. There are no redevelopment plans for the
property at this time.

(c) The City of Fort Collins plans to extend municipal services
into the area of the above referenced annexation. The City
operates under a "development must pay its own way" philosophy
whereby, the cost of needed extensions of infrastructure (utilities
and streets) are borne by the developer requiring those extensions.
The City participates in any required "oversizing" of
infrastructure and finances such requirements from the City's
Oversizing Fee structure. The developer has several optional
methods to finance infrastructure extensions including the use of
Special Improvement Districts (SIDS). The City also collects fees
for the extension and upgrading of storm drainage systems and the
purchase and construction of parks and recreational facilities.
Other municipal services, such as police protection, are financed
from the City's General Fund.
(d) The following districts presently provide service within the
above referenced annexation:

OF THE COUNCIL OF THE CITY OF FORT COLLINS
STATING THE INTENT OF THE CITY OF FORT COLLINS
TO ANNEX CERTAIN PROPERTY AND INITIATINGANNEXATION
PROCEEDINGS FOR SUCH PROPERTY TO BE KNOWN AS THE K-2 ANNEXATION
WHEREAS, the property hereinafter described has, for a period of not less than three (3)
years prior to this date, been completely contained within the boundaries of the City of Fort Collins;

WHEREAS, the Council desires to initiate annexation proceedings in accordance with State

PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a
Resolution initiating annexation proceedings for the K-2 Annexation, said Annexation being more
particularly described in said Resolution, a copy of which precedes this Notice.
That, on July 1, 1997, at the hour of 6:00 p.m.. or as soon thereafter as the matter may come
on for hearing in the Council Chambers in the City Hall, 300 LaPorte Avenue. Fort Collins,
Colorado, the Fort Collins City Council will consider the passage of an annexation ordinance
concerning the subject property.
The City of Fort Collins will make reasonable accommodations for access to City services,
programs and activities and will make special communication arrangements for persons with

Ladies and Gentlemen:
Fort Collins is an ideal place to live, but does Fort
Collins want to right size or down size? This is only a
question the board can answer with a yes or no vote.
Right size.
We were planing to expand the operation with more trucks and
more mechanics. This means more jobs for the local economy.
Right size!!!
More trucks means we will purchase more parts from the local
parts stores, more business means more office supplies and
cleaning supplies will be needed. We will also add more
trees and shrubbery and flowers to our area which means more
gardening supplies.
We purchase anywhere from 2 to 4 thousand dollars per truck
in parts and labor per month. Averaging 24,000 dollars per
year per truck.
We have 14.5 acres which we farm 12 acres, this property
also has lease hunting rights.
Down Size
If we are forced into the city what happens?
We will not be able to expand do to the following:
The taxes on new trucks and equipment purchased. Costing us
an additional $45,000.00 per year.

The extra city tax charged would run about 1,872.00 per year
per truck on parts alone.
We loose the lease hunting rights for our property.
We already pay city tax on purchases on office supplies,
cleaning supplies and gardening supplies so there would be
no change for either side.
Loss of customers. If our cost go up so must the consumers.
The consumers that we serve are already feeling the squeeze
in more ways than one and we will not be apart of it.
What do we get in return from the city? As far as I can see
NONE. If the surrounding area was incorporated into the
city in 1988 what improvements have been made'
What does the city get if we are incorporated.
Loss of Jobs, Loss of revenue, Loss of business in downtown
area, and loss of respect.
We will move our operations into Weld Co.
Weld Co. and the Greeley Area will reap the rewards of not
only the business mentioned above, but we also have people
in from California 2 and 3 times a month, which means out of
town money spent at hotels and motels, eating out and car
rental. Not to mention the money spent at gift shops in old
town, which we always recommend our guest visit.
In moving to Weld Co. we can feel good about keeping our
prices down for our farmers and ranchers that use our
product. As you see there are only 2% of the U.S.
population that is providing the food that goes on your
table everyday and the number is decreasing steadily. In
the last year alone we have seen at least 5 farms and
dairies sellout as they could not make it do to high costs.
If people are forced to increase prices as we would because
of city taxes it only hurts the economy in the long run and
may even raise the cost of your food bill in the future.

Please say no to the annexation and keep the revenue in your
pocket that you already have. Don't be like the dog that
saw his own reflection in the water and drop the bone you
have, to go after something that won't even be there.
