Would like more time to review information. Member Weitkunat recommended denial of the annexation. Member Davidson again expressed concern about not having enough time to study information. Member Colton expressed a concern about closure on the electrical issue, pipe coating and noise issue. Salazar offered information on the noise issue. Moved by Davidson, seconded by Colton: Recommended a continuance until July 3 at which time there should be a resolution regarding noise control. Gavaldon abstained. Weitkunat voted against. Member Colton supported the motion because of major unknowns relating to information clarification. K-2 ENCLAVE STAFF REPORT There are three property owners; approximately 30 acres. This property became eligible for annexation in October of 1991. This property is surrounded by industrial property, low density mixed use neighborhoods. Issues are: Hubb Enterprise has an issue regarding extension of utility services. Those extensions would not occur until development begins. 2. Ft. Collins Feed has an issue with the city's use tax especially in regard to feed trucks, computers, fuel. 3. Mr. Just echoed concerns and wanted to know who would pay for conversion of power. It was stated that all conversion is paid by the city. A letter from Ft. Collins Feed and Mr. Just were provided to the Board. PUBLIC PARTICIPATION Steve Woodward, General Manager of Ft. Collins Feed, expressed concern about the tax issue. A letter from Mr. Just was read by Mr. Ball. Planning and Zoning Board Minutes April 14, 1997 Page 6 Mr. Ball gave a short synopsis of his business and where it is located. He talked with property owners in the surrounding area whose property had been annexed a few years previous. These people gave an opinion that they would rather not have been annexed if they had to do it over again. BOARD QUESTIONS Member Weitkunat asked about fees regarding annexation. Staff responded that fees would not be charged unless a change to property was made. Member Davidson asked about the Urban Growth Requirement. Wanted to know what incentives businesses have to want to be annexed. Member Colton wanted to know why the City wants to annex. Staff said the City wants to consolidate properties into the city so more control could be given regarding services and future development and expansion. Member Gavaldon asked about additional costs and taxes. Staff said computers and trucks would be subject to use tax. Gasoline and diesel are not subject to tax. Moved by Weitkunat, seconded by Davidson: Recommended denial of the K-2 Enclave annexation. Passed unanimously. Member Weitkunat did not see any benefit to annexation and serious drawbacks for people who own the property. The other Board Members agreed and gave brief comments. WILLOWSPRINGS NORTH PUD - PRELIMINARY, #3-94G STAFF PRESENTATION This is a request for a combination single family and multi -family residential project. The site is 26.59 acres, located west of Timberline Road, north of Battlecreek Drive, east of Union Pacific railroad tracks. Single family portion consists of 35 lots on 9.72 acres west of Wilmington Drive. The multi -family portion consists of 280 dwelling units divided among 15 buildings on 15.59 acres. Located east of Wilmington Drive. Includes clubhouse, pool and play area. There are 315 dwelling units. The site was zoned RLP. Now zoned LMN. This project has been submitted under the Land Development Guidance System. Slight change in density chart to 101 points. Staff is recommending approval with a condition.
