Dear Mr. Woodward:
I have reviewed your January 13, 1992 letter in which you describe
the current use of the property owned by Newhall Land and Farming
Company. Based on your description I would classify the use of the
property shown on map 2 as being principally an office use, with
accessory uses of parking and maintenance. The use of the
remaining 12 acres would be classified as farming.
It is my understanding that upon annexation the property is going.
to be zoned IL (limited industrial) with a PUD condition. This
will mean that development will be allowed only if it is located on
a planned unit development plan. Since your present use and
development is not located on such a plan, the use will be
classified as a legal, nonconforming use. This means that the use
of the property will be allowed to continue until such.time that it
is abandoned for a period of 12 consecutive months. As a legal,
nonconforming use, any expansion of the building containing the
office space or bay area will be required to be approved by the
Fort Collins Planning and Zoning Board. Any change of use from the
above -described use to a different use will also be required to be
approved by —the Planning and Zoning Board. A change of ownership
will not affect the legal, nonconforming status of the -property. --
(The use can continue indefinitely even if the ownership changes,
until such time that the use is abandoned for a period of 12.
consecutive months).

Dear Mr. Barns;
We will be anexed into the city of Fort Collins. We are in the
process of selling the property and we would like a written letter
stating that there will be no problem with the transition.
We run a trucking operation; we purchase the wet brewers.grain
from Anheuser-Busch and sell it to daries and feedlots in the area.
We have five trucks that we run 20 hours a day 7 days a week.
We do minor maintenance at this location.
The facility is used mainly for parking and we have awash bay
to keep the trucks clean.
We do no loading or unloading of trucks at this site.
There is about 720 sq/ft. of office space and 5,700 sq./ft. of
enclosed bay area.
The origional property is 2.77 acres and we purchased another
12t acres that we farm.
Map 1 is the entire property that we own. Map 2 is the office
area.
