HomeMy WebLinkAboutCAMERON PARK ANNEXATION AND ZONNG 2.4.92 CITY COUNCIL HEARING - 52 91 - REPORTS - INITIATING RESOLUTIONKirsten Whetstone February 4, 1992 SUBJECT: Resolution 92-XX Stating Intent to Annex Certain Property and Initiating Annexation Proceedings for Cameron Park Annexation. RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: The property being considered for annexation is approximately 5.78 acres in size and is located west of Highway 287, south of Harmony Road and north of Trilby Road at Cameron Drive. The annexation is comprised of 10 properties within Cameron Park Subdivision. The properties are currently part of an existing business park. There are several office buildings associated with the business park. Four of the lots are vacant. The properties are currently zoned B. Business, in the County. The proposed zoning for this annexation is BL, Limited Business. The proposed Resolution determines that the annexation complies with the Municipal Annexation Act and the policies of the Intergovernmental Agreement for the Fort Collins Urban Growth Area. The Resolution also determines that a.hearing should be established regarding the annexation and directs that notice be given of the hearing. The hearing will be held at the time of first reading of the annexation and zoning ordinances on March 17, 1992. BACKGROUND: The properties are located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Urban •Growth -Area., —(.specifically__ . policy # 2.10 c) the City will agree to consider annexation of property in the UGA when the property is eligible for annexation according to state law. Enclave areas become eligible for annexation when they have been completely surrounded, by properties annexed into the City, for at least three years. The properties became eligible for annexation as an enclave on November 15, 1991. The properties became completely surrounded by the City of Fort Collins through the following annexations: N: Mill First Annexation, January 6, 1987 E: Fossil Creek 1st Annexation, June 5, 1984 and Fossil Creek 3rd Annexation, April 2, 1985 S: Fossil Creek West 1st Annexation, November 15, 1988 W: Fossil Creek West 1st Annexation, November 15, 1988 IJ The annexation is made up of ten parcels which are under separate ownership. Genevive Enterprises, Inc. 1142 Cobblestone Ct. Fort Collins, CO 80525 7. Larson, Kenneth A. 1350 Teakwood Dr. Fort Collins, CO 80525 8. Musgrave, F.L. & Tobey, R.W. 2715 E. Floral Place Denver, CO 80210 9. Musgrave, Frank (same as above) 10. Musgrave, F.L. & Tobey, R.W. (same as above) The properties are currently zoned B. Business, in the County. The proposed zoning for this annexation is BL, Limited Business. The surrounding properties are zoned BP, Planned Business with a PUD condition; HB, Highway Business with a PUD condition; and BL, Limited Business with a PUD condition. The proposed zoning creates the fewest non -conforming uses and is compatible with the surrounding zoning. Planning and Zoning Board Recommendation: The Planning and Zoning Board will conduct a public hearing on the annexation and zoning request at their regular monthly meeting on February 24, 1992, and will make their recommendation at that time. The Board's recommendation will be forwarded to the City Council in time for the first readings of the ordinances annexing and zoning the area, scheduled for March 17, 1992. RESOLUTION 92- OF THE COUNCIL OF THE CITY OF FORT COLLINS. STATING THE INTENT OF THE CITY OF FORT COLLINS TO ANNEX CERTAIN PROPERTY AND INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY TO BE KNOWN AS THE CAMERON PARK ANNEXATION WHEREAS, the property hereinafter described has, for a period of not less than three (3) years prior to this date, been completely contained within the boundaries of the City of Fort Collins; and WHEREAS, the Council desires to initiate annexation proceedings in accordance with law. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That, the Council of the City of Fort Collins intends to annex the following described property, to be known as the Cameron Park Annexation, situate in the County of Larimer, State of Colorado, to wit: A tract of land situate in the Southeast Quarter of Section 2, Township 6 North, Range 69 West of the 6th P.M., Larimer County, Colorado, which considering the East line of the Southeast Quarter of said Section 2 as bearing N 00*3812911 E and with all bearings contained herein relative thereto is contained within the boundary lines which begin at the Southeast Corner of said Section 2 and run thence N 00038129/1 E 1752.70 feet; thence N 88*5313111 W 48.57 feet to the true point of beginning; thence N 88053131/1 W 289.00 feet; thence N 46053131/1 W 170.00 feet; thence N 36053131/1 W 100.00 feet; thence N 62*3612911 E 216.16 feet; thence along the arc of a 145.00 foot radius curve to the left a distance of 174.21 feet, the long chord of which bears N 61048142/1 W 163.92 feet; thence N 00039149/1 E 172.02 feet; thence along the arc of a 50.00 foot radius curve to the right a distance of 132.16 feet, the long chord of which bears N 59022143/1 E 96.91 feet; thence along the arc of a 15.00 foot radius curve to the left a distance of 19.12 feet, the long chord of which bears S 52050104/0 E 17.85 feet; thence S 89020111" E 162.84 feet; thence N 00039149/1 E 119.93 feet; thence S 88*5313111 E 170.00 .feet; thence S 00039150/1 W 704.00 feet to the point of beginning. Containing 5.7778 acres. Section 2. That the Council hereby initiates annexation proceedings for the above -described property. Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said Notice establishes the date, time and place when a hearing will be held regarding the passage of an annexation ordinance pertaining to the above described property. The City Clerk is directed to publish a copy of this Resolution and said Notice as provided in Section 31-12-108(2), C.R.S. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 4th day of February, A.D. 1992. That, on March 17, 1992, at the hour of 6:30 p.m., or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall, 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City Council will hold a hearing for the purpose of finding and determining whether the property proposed to be annexed meets the applicable requirements of Colorado law and is considered eligible for annexation. City Clerk ORDINANCE NO. , 1992 OF THE COUNCIL OF THE CITY OF FORT COLLINS, AMENDING THE ZONING DISTRICT MAP CONTAINED IN CHAPTER 29 OF THE CODE OF THE CITY OF FORT COLLINS AND CLASSIFYING FOR ZONING PURPOSES THE PROPERTY INCLUDED IN THE CAMERON PARK ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1.
