RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: The property being considered for annexation is approximately 2.31 acres in size and is located at 2637 W. County Road 40, located south of Horsetooth Road, west of Taft Hill Road, and north of County Road 38E. The property is located within the Urban Growth Area. There is a single family home on the property. The property is currently zoned FA, Farming, in the County. The proposed zoning for this property is RLP, Low Density Planned Residential. The surrounding properties are zoned RLP. The proposed Resolution determines that the annexation complies with the Municipal Annexation Act and the policies of the Intergovernmental Agreement for the Fort Collins Urban Growth Area. The resolution also determines that a hearing should be established regarding the annexation and directs that notice be given of the hearing. The hearing will be held at the time of first reading of the annexation and zoning ordinances on March 17, 1992. BACKGROUND: The property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area (policy #2.10 c), the City will agree to consider annexation of property in the UGA when the property is eligible for annexation according to state law. Enclave areas become eligible for annexation when they have been completely surrounded, by properties annexed into the City, for at least three years. The property became eligible for annexation as an enclave on October 6, 1990. The property became completely surrounded by the City of Fort Collins through the following annexation. County Road 40, Fort Collins, CO 80526. The property is currently zoned FA, Farming, in the County. The proposed zoning for this annexation is RLP, Low Density Planned Residential, which is compatible with the existing uses and surrounding zoning. Planning and Zoning Board Recommendation: The Planning and Zoning Board will conduct a public hearing on the annexation and zoning .ti request at their regular monthly meeting on January 27, 1992, and will make their recommendation at that time. The Board's recommendation will be forwarded to the City Council in time for the first readings of the ordinances annexing and zoning the area, scheduled for March 17, 1992. Or RESOLUTION 92- OF THE COUNCIL OF THE CITY OF FORT COLLINS I STATING THE INTENT OF THE CITY OF FORT COLLINS TO ANNEX CERTAIN PROPERTY AND INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY TO BE KNOWN AS THE BARNES ANNEXATION WHEREAS, the property hereinafter described has, for a period of not less than three (3) years prior to this date, been completely contained within the boundaries of the City of Fort Collins; and WHEREAS, the Council desires to initiate annexation proceedings in accordance with law. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That, the Council of the City of Fort Collins intends to annex the following described property, to be known as the Barnes Annexation, situate in the County of Larimer, State of Colorado, to wit: A tract of land situate in the Northwest Quarter of Section 33, Township 7 North, Range 69 West of the 6th P.M., Larimer County, Colorado, which considering the North line of the said Northwest Quarter as bearing N 89002115/1 E and with all bearings contained herein relative thereto is contained within the boundary lines which begin at the North Quarter Corner of said Section 33 and run thence S 00021115/1 W 1102.60 feet; thence S 89014115/1 W 194.00 feet to the true point of beginning; thence S 88034115/1 W 332.00 feet; thence N 0600111511 E 272.42 feet; thence N 30059145/1 W 71.78 feet; thence S 87*2714511 E 335.24 feet; thence S 04034115/9 W 165.98 feet; thence N 88*3411511 E 30.17 feet; .thence S 04034115/1 W 145.06 feet to the point of beginning. Containing 2.3132 acres. Section 2. That the Council hereby initiates annexation proceedings for the above -described property. Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said Notice establishes the date, time and place when a hearing will be held regarding the passage of an annexation ordinance pertaining to the above described property. The City Clerk is directed to publish a copy of this Resolution and said Notice as provided in Section 31-12-108(2), C.R.S. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 4th day of February, A.D. 1992. Mayor ATTEST: City Clerk NOTICE TO ALL PERSONS INTERESTED: PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a Resolution initiating annexation proceedings for the Barnes Annexation, said Annexation being more particularly described in said Resolution, a copy of which precedes this Notice. That, on March 17, 1992, at the hour of 6:30 p.m., or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall, 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City Council will hold a hearing for the purpose of finding and determining whether the property proposed to be annexed meets the applicable requirements of Colorado law and is considered eligible for annexation.
