County Road 40 Fort Collins, CO 80521 PROJECT DESCRIPTION: Request to annex and zone approximately 2.31 acres located at 2637 W. County Road 40, located south of Horsetooth Road, west of Taft Hill Road, and north of County Road 38E. There is a single family residence on the property. The proposed zoning is RLP, Low Density Planned Residential. This is the annexation of an enclave area. RECOMMENDATION: Staff recommends approval of the annexation and zoning request. EXECUTIVE SUMMARY: This is a request to annex and zone approximately 2.31 acres located at 2637 W. County Road 40, located south of Horsetooth Road, west of Taft Hill Road, and north of County Road 38E. The annexation consists of one parcel of land with an existing single family residence. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will agree to consider for annexation, property in the UGA when the property is eligible for annexation according to State law. The property being considered for annexation has, for a period of not less than three (3) years, been completely surrounded by property contained within the boundaries of the City of Fort Collins. Enclave areas become eligible for annexation when they have been completely surrounded, by properties annexed into the City, for at least three years. The area to be annexed has been a county enclave for at least three years and is therefore eligible for annexation. The property became completely surrounded by the City of Fort Collins through the following annexation: N: Overland Hills Annexation, October 6, 1987 E: Overland Hills Annexation, October 6, 1987 S: Overland Hills Annexation, October 6, 1987 W: Overland Hills Annexation, October 6, 1987 The property is currently used as a private rural residence. Horses are allowable, as an accessory use in the RLP District. Any farm animals such as goats, pigs, chickens, and cows would become non -conforming uses. If active and continuous operations are not carried on in a nonconforming use during a continuous period of one year, the building, structure, or land where such non -conforming uses previously existed would revert back to conforming uses only. There are no redevelopment plans for this property at this time. The property became eligible for involuntary annexation into the City on October 6, 1990. On December 18, 1991, staff sent a letter to the property owners informing them of the pending annexation, potential zoning district designation, and the various meeting dates for review by the Planning and Zoning Board and the Fort Collins City Council. Zoning• The property is currently zoned FA, Farming, in the County. The proposed zoning for this annexation is RLP, Low Density Planned Residential. The RLP District designation is for areas of low density residential development. The proposed zoning is compatible with the existing uses and surrounding zoning and is consistent with the policies of the City's Comprehensive Plan. The annexation of this property is consistent with the policies and agreements between Larimer County and the City of Fort Collins as contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. 2. The area meets all criteria included in State law to qualify for annexation by the City of Fort Collins. 3. On February 4, 1992, City Council will consider a resolution setting forth the intent to annex this property and establishing the date of public hearing for the annexation and zoning ordinances. Ordinances to annex and zone the property will be considered by City Council on March 17, 1992. 4. The requested zoning of RLP, Low Density Planned Residential, is in conformance with the policies of the City's Comprehensive Plan. RECOMMENDATION: Staff recommends approval of the annexation and requested zoning.
