Resolution 92- 2 Finding Substantial Compliance and Initiating Annexation
Proceedings for the Pickett Second and Third Annexations.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The applicant, Gary Nordic (309 W. Harmony Road, Ft. Collins, CO 80525), on
behalf of the property owner, Eric Peterson (1919 Westview Road, Ft. Collins, CO
80521), has submitted written petitions requesting annexation of:
(1) approximately 854 square feet, located just east of the terminus of
Spaulding Lane, south of Country Club Road. (Pickett Second)
(2) approximately 10,605 square feet, located just south of the terminus of
Westview Road, south of Country Club Road. (Pickett Third)
The proposed Resolution makes a finding that the petitions substantially comply
with the Municipal Annexation Act, determines that hearings should be established
regarding the annexations, and directs that notice be given of the hearings. The
hearings will be held at the time of first reading of the annexation and zoning
ordinances. Not less than thirty days of prior notice is required by Colorado
law.
The property is located within the Fort Collins Urban Growth Area. According to
policies and agreements between the City of Fort Collins and Larimer County
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH
AREA, the City will consider the annexation property in the UGA when the property
is eligible for annexation according to state law. The property gains the
required 1/6 contiguity to existing city limits from a common boundary with the
Pickett Annexation to the south.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board will conduct public hearings on the request for
annexation and zoning at its regular monthly meeting on January 27, 1992, and
will make its recommendation at that time. The Board's recommendation will be
forwarded to the City Council in time for the public hearings and first readings
of the annexation and zoning ordinances scheduled for February 18, 1992.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
FINDING SUBSTANTIAL COMPLIANCE AND
INITIATING ANNEXATION PROCEEDINGS FOR THE
PICKETT SECOND AND THIRD ANNEXATIONS
WHEREAS, a written petition, together with four (4) prints of an annexation
map, was heretofore filed with the City Clerk requesting the annexation of
certain property to be known as the Pickett Second and Third Annexations; and
WHEREAS, the Council of the City of Fort Collins desires to initiate
annexation proceedings in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the Council of the City of Fort Collins hereby accepts the
annexation petition for the Pickett Second and Third Annexations, more
particularly described as situate in the County of Larimer, State of Colorado,
to wit:
Pickett Second:
A Tract of land situate in the Southeast 1/4 of Section 36, Township
8 North, Range 69 West of the Sixth P.M., Larimer County, Colorado,
which, considering the West Line of said Southeast 1/4 as bearing N
00°15'50" W and with all bearings contained herein relative thereto,
is contained within the boundary lines which begin at a point which
bears N 00°15'50" W 1322.95 feet, and again N 89'57'40" E 526.07
feet from the South 1/4 Corner of said Section 36 and run thence
NORTH 30.00 feet; thence N 89°57'40" E 4.91 feet; thence along the
arc of a 30.00 foot radius curve to the right a distance of 47.12
feet, the long chord of which bears S 45°02'20" E 42.43 feet; thence
S 89°57'40" W 34.93 feet to the point of beginning, containing 854
square feet, more or less.
Pickett Third:
A part of Lot 5, Terry Ridge, situate in the North 1/2 of the
Southeast 1/4 of Section 36, Township 8 North, Range 69 West of the
Sixth P.M., Larimer County, Colorado, which considering the North
line of the said Southeast 1/4 as bearing East and with all bearings
contained herein relative thereto is contained within the boundary
lines which begin at the Southeast corner of said Lot 5 and run
thence along the South line of said Lot 5, S 89057'40" W 112.15
feet; thence along the arc of a non -tangent 543.45 foot radius curve
to the left a distance of 172.42 feet, the long chord of which bears
N 24`11'42" E 171.70 feet to a point on the Easterly line of said
Lot 5; thence along said Easterly line along the arc of a non -
tangent 50.00 foot radius curve to the left a distance of 49.46
feet, the long chord of which bears S 61°39'47" E 47.47 feet; thence
continuing along said Easterly line, South 134.01 feet to the point
of beginning, containing 10,605 square feet more or less.

Section 2. That the Council hereby finds and determines that the annexation
petition and accompanying map are in substantial compliance with the Municipal
Annexation Act, and desires to initiate annexation proceedings in accordance with
law.
Section 3. That the Notice attached hereto be adopted as a part of this
Resolution. Said Notice establishes the date, time and place when a public
hearing will be held regarding the passage of an annexation ordinance pertaining
to the above described property. The City Clerk is directed to publish a copy
of this Resolution and said Notice as provided in the Municipal Annexation Act.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 7th day of January, A.D. 1992.

TO ALL PERSONS INTERESTED:
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has
adopted a Resolution initiating annexation proceedings for the Pickett Second and
Third Annexations, said Annexations being more particularly described in said
Resolution, a copy of which precedes this Notice.
That, on February 18, 1992, at the hour of 6:30 p.m., or as soon thereafter
as the matter may come on for hearing in the Council Chambers in the City Hall,
300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City Council will
hold a public hearing upon the annexation petition for the purpose of finding and
determining whether the property proposed to be annexed meets the applicable
requirements of Colorado law and is considered eligible for annexation. At such
hearing, any persons may appear and present such evidence as they may desire.
