RE: Pinecone P.U.D. Rezoning
The recommendation in the agenda summary indicates that the area to
be rezoned B-P, Planned Business, should be rezoned with a P.U.D.
condition. The stated reason for imposing the condition is to
emphasize to the public that no "business development" is allowed
in the zone without having P.U.D. approval.
The B-P zone authorizes basically two uses: (1) any use permitted
in the R-M zone and (2) any use developed as a P.U.D. Since
business uses are not authorized in the R-M zone, they already must
be processed through the Land Development Guidance System, even in
the absence of the imposition of a P.U.D. condition. Although it
is not improper to impose a P.U.D. condition on "business
development," if there is no legitimate reason to impose the P.U.D.
condition on residential development, then such imposition would be
arbitrary. Therefore, it is our recommendation that the P.U.D.
condition to be imposed upon the B-P zone be limited to a P.U.D.
condition for any use not permitted in the R-M zone. That way, the
uses permitted in the R-M zone could still be developed without
being processed through the Land Development Guidance System.
Please consider this memorandum as an amendment to the staff
recommendation as contained in the agenda summary.
