Per your request, here is written documentation of our phone
conversation this morning. As I mentioned, the subject site is in the
NC —Neighborhood Commercial District. In this district, fast food
restaurants are allowed, but not with drive -through facilities.
On the phone I told you that the Pinecone—Tower Shoppes PUD expired,
but I was wrong; I did some research and discovered that the PUD is in
fact still in effect per a memo from the City Engineer dated 2003.
However, when I looked up the PUD Final Plans in our archive (#T43-
1943) there was no specific use proposed for Lot 2. Therefore, proposals
for that lot must meet the current standards in our Land Use Code,
adopted in 1997. As I stated above, a drive -through restaurant is not an
allowable use for this parcel.
Allowable uses are not a modifiable aspect of the Land Use Code, so
there is no mechanism available to petition changing them. As a
community, we have decided to focus commercial in the neighborhood
areas on pedestrian -friendly development.
We hope you will consider another more suitable site in Fort Collins for a
drive through Taco Bell. Fast food restaurants with drive -through
facilities are allowed in the C—Commercial and CN—Commercial North
College, subject only to Building Permit review and the CL—Limited
Commercial Zone Districts subject to a Type I Administrative Review.
They are also allowed in the E—Employment and I —Industrial Zone
Districts as a part of a convenience shopping center subject to a Building
Permit review.
