Dear Bob;
This letter represents a request by TIMBERLINE PARTNERS LIMITED for two (2)
successive six (6) month extensions that may be granted administratively for the Tower
Shoppes at Pinecone, Final P.U.D. This will extend the validity of the plan from August 11,
1998 to August 1 1 , 1999.
The Tower Shoppes at Pinecone, Final P.U.D. was approved by the Planning and
Zoning Board on June 5, 1995, with conditions; including the standard condition requiring a
development agreement be negotiated and executed by the developer. The language in that
condition states that:
"The date of final approval for this planned unit development shall be deemed to be the
date that the condition is met, for purposes of determining the vesting of rights. "
The subject condition was met on August 1 1 , 1995.
According to the Land Development Guidance System in effect at the time the Tower
Shoppes at Pinecone, P.U.D. was submitted to the City of Fort Collins:
Time limit for validity of the final plan. The applicant must undertake and complete the
development of an approved final plan within three (3) years from the time of final
approval. For purposes of this section, a development is substantially complete once
all engineering improvements (water, sewer, streets, curb, gutter, street lights, fire
hydrants, and storm drainage) are installed and completed in accordance with City
rules and regulations. Extensions for two (2) successive periods of six (6) months may,
upon finding that the plan complies with all "Review Criteria" as contained in Section
29-526(D) a the time of the application for extension, be administrative granted by the
Director of Planning.
While many of the required public improvements have been completed, some of the
remaining improvements cannot be completed by August 11,1998, without creating
conditions that would likely require their demolition and reconstruction at a later date.

Because Tower Shoppes is part of an ODP of over 100 acres that was largely completed at
the time the new Land Use Code was adopted, the property is subject to the "Review Criteria"
of the LDGS. The Final PUD Plan complies with all Review Criteria as contained in Section
29-526(D).
We appreciate your attention to this request. Please let us know the disposition of the
two, six month extensions as soon as possible.
