This will require the landscape plan to properly demonstrate which tree will remain and be removed. Full tree stocking is also required within 50 feet of the building. Please consult with City Forestry department if any recommendations for trees are required. Reflected on plan Department: Engineering Development Review Contact: Marc Virata, 970-221-6567, mvirata@fcgov.com Topic: General Comment Number: 1 01/06/2020: for information: Comment Originated: 01/06/2020 As previously discussed with the applicant, the City has re -looked at the concept of repayment of local street portions of street at the adopted yearly cost per foot when considering abutting low density single family. This comment confirms that with the present application, the City is not looking to assess a repayment at the adopted yearly cost per foot. At this time, we have not arrived at a determination/policy of how to assess a repay amount in these situations, however, the discussion is ongoing with a meeting at the end of the week with our Director to verify if an updated policy can be adopted at this time, or will this timetable further extend. Absent of an adopted approach, we would look to indicate in a development agreement for the development application of the property that the local portion repay is still applicable to the property and would look to be enforced with any further development/redevelopment of the property. Noted for information Comment Number: 2 Comment Originated: 01/06/2020 01/06/2020: for approval: The applicant has provided the same set for both a civil plan set and a site plan. The plan sets need to have slightly different information between the two of them, where the civil plans have a City Utility Plan Approval Block and any appropriate details required by City Utilities. The Owner's Certificate and Planning Certificate would be needed only on the Site Plan. It was determined by the plan developer that all information can adequately fit on 1 set, Appropriate approval blocks, owner certificates etc have been added packet Comment Number: 3 Comment Originated: 01/06/2020 01/06/2020: priortohearing: Indication from the ditch company of a letter of intent (agreement in concept) to the proposal is needed prior to a hearing, with the actual agreement with the ditch and signature on the plans required before final approval. Crossing agreement has been developed, signed, paid for and recorded and is included in this review Department: Traffic Operation 2 Contact: Martina Wilkinson, 970-221-6887, mwilkinson@fcqov.com Topic: General Comment Number: 1 Comment Originated: 12/31/2019 12/31/2019: FOR INFORMATION The project is only a single family home, which does not meet the threshold for requiring a traffic study. The canal prevents the ability to easily access Falcon drive, and there is an existing curb cut in Taft Hill at the proposed access location. No transportation related changes are needed. The access is limited to right -in, right -out usage. Noted Department: Environmental Planning Contact: Kelly Smith, ksmith@fcgov.com Topic: General Comment Number: 4 Comment Originated: 01/08/2020 01/08/2020: Please include a table on the landscape plans indicating the SF of proposed buffer zone area versus the buffer zone using the 50 foot setback, the minimum buffer distance and the maximum buffer distance. Ensure the buffer zone boundary on site, utility and landscape plans clearly identify the buffer zone and does not include the area where the driveway and parking stalls encroach into the 50 foot buffer. Reflected on plan Comment Number: 5 Comment Originated: 01/08/2020 01/08/2020: The environmental planner will conduct a site visit to assess mitigation requirements for trees and vegetation being removed by the applicant. The environmental planner will provide species and location recommendations. Mitigation plants should be included in a table, and could be integrated into Forestry's mitigation table. Reflected on plan Comment Number: 6 Comment Originated: 01/08/2020 01/08/2020: Section 3.4.1 of the Land Use Code requires: "To the extent that a development plan proposes the creation of water features such as lakes, ponds, streams or wetlands, the plan must include clear and convincing evidence that such water features will be supplied with sufficient water whether by natural means or by the provision of sufficient appropriative water rights. No development plan shall be approved which would have the effect of injuring or diminishing any legally established water supply for any natural area." To this end the plans will have to demonstrate via narrative the intent of the pond (seasonal or year round) and the amount of water required to meet the intent. The plans will also require approval from the ditch company that your shares meet the intent of the pond. Further Discussions made, Kelly and I decided a narrative will not be necessary as ditch company of course will regulate their water effectively Also, you will be required to restore any disturbed vegetation in the NHBZ as a result of installing the pipe and headgates Noted Comment Number: 7 Comment Originated: 01/08/2020 3 01/08/2020: Please send Tenae Beane a copy of the ECS. Comment Number: 8 Comment Originated: 01/08/2020 adequate? 01/08/2020: Because of the proximity of your site to the ditch, you are required to provide the City with the ditch company's approval of your project. Crossing agreement is in place, ditch company does have a signature block on the plan Comment Number: 9 Comment Originated: 01/08/2020 01/08/2020: Please add an Environmental Planner signature to all utility plans that show the buffer zone. This was not done on the revised set, note there is only plan requiring a general planning certificate, is this Comment Number: 10 Comment Originated: 01/08/2020 01/08/2020: Please add the top -of -bank line to any plans with the habitat buffer zone on it. Reflected on plan Comment Number: 11 Comment Originated: 01/08/2020 01/08/2020: If tree removal is necessary, please include the following note on the tree mitigation plan and/or landscape plan, as appropriate: "NO TREES SHALL BE REMOVED DURING THE SONGBIRD NESTING SEASON (FEBRUARY 1 TO JULY 31) WITHOUT FIRST HAVING A PROFESSIONAL ECOLOGIST OR WILDLIFE BIOLOGIST COMPLETE A NESTING SURVEY TO IDENTIFY ANY ACTIVE NESTS EXISTING ON THE PROJECT SITE. THE SURVEY SHALL BE SENT TO THE CITY ENVIRONMENTAL PLANNER. IF ACTIVE NESTS ARE FOUND, THE CITY WILL COORDINATE WITH RELEVANT STATE AND FEDERAL REPRESENTATIVES TO DETERMINE WHETHER ADDITIONAL RESTRICTIONS ON TREE REMOVAL AND CONSTRUCTION APPLY." Reflected on plan Comment Number: 12 Comment Originated: 01/08/2020 01/08/2020: If exterior mounted light fixtures are to be installed on the home, please ensure they are down directional and fully shielded. Also ensure there is no light spillage into the buffer zone. In regard to LED light fixtures, cooler color temperatures are harsher at night and cause more disruption to circadian rhythms for both humans and wildlife. Please use a warm white color temperature (3000K or less) for your LED light fixtures. Also consider fixtures with dimming capabilities so that light levels can be adjusted as needed. Revised plan set does not include any verbiage to this comment, assumed it was an "informational" note, as such it is noted and will be adhered to during construction of home Comment Number: 13 Comment Originated: 01/08/2020 01/08/2020: Language regarding the protection and enhancement of the Natural Habitat Buffer Zone will be included in the Development Agreement for this project. A security will need to be provided prior to the issuance of a Development Construction Permit that accounts for the installation and establishment of the Natural Habitat Buffer Zone. Prior to DCP, please provide an estimate of the landscaping costs for the Natural Habitat Buffer Zone, including materials, labor and irrigation. We will then use the approved estimate to collect a security (bond or escrow) at 125% of the total amount. Because this project is not exempt, an on -site tree inventory is required. Any tree removal planned by the developer/property owner must be mitigated on -site in the form of mitigation trees. Any tree removal completed by the ditch company will not require on -site mitigation and can be excluded from the landscape plan. Prior to the next submittal, please schedule an on -site tree inventory and mitigation meeting with City Forestry. Existing significant trees shall be retained and protected to the extent reasonably feasible. Reflected on plan The existing tree inventory and mitigation table (provided by City Forestry) must be included on the next submittal's landscape plan. Trees proposed to be removed shall be shown with a X over the symbol Trees to be retained should be identified with a unique symbol. Reflected on plan Please add a note to the Site/Landscape Plan stating the following: "Tree Mitigation requirements as required by 3.2.1(F), Tree Preservation and Mitigation, shall not apply to the boundary of the Pleasant Valley Lake and Canal Company's easement and shall be excluded from the Limits of Development due to the exclusive right of the ditch company to operate, maintain, alter, enlarge relocate, clean, and manage the ditch. The City of Fort Collins Land Use Code expressly excludes the use of land for the purpose of delivering water by ditch or canal from the definition of development, provided that it does not create a nuisance. 5 Reflected on plan Comment Number: 2 Comment Originated: 01/07/2020 1/7/2020: FOR FINAL APPROVAL An Existing Tree Removal Feasibility Letter may be required. Proposals to remove existing trees must provide a justification letter detailing the reason for tree removal. This is required for all development projects proposing significant tree removal regardless of the scale of the project. The purpose of this letter is to provide a document of record with the project's approval and for the City to maintain a record of all proposed significant tree removals and justifications. Existing significant trees within the project's Limits of Disturbance (LOD) and within natural area buffer zones shall be preserved to the extent reasonably feasible. Streets, buildings and lot layouts shall be designed to minimize the disturbance to significant existing trees. (Extent reasonably feasible shall mean that, under the circumstances, reasonable efforts have been undertaken to comply with the regulation, that the costs of compliance clearly outweigh the potential benefits to the public or would unreasonably burden the proposed project, and reasonable steps have been undertaken to minimize any potential harm or adverse impacts resulting from noncompliance with the regulation.) Where it is not feasible to protect and retain significant existing tree(s) or to transplant them to another on -site location, the applicant shall replace such tree(s) according to City mitigation requirements.
