Phase III Project No. 10-746-050 Dear Planning & Zoning Board: November 23, 1994 With this letter we are requesting a variance to the "Land Development Guidance System for Planned Unit Developments" Section (5) Final Plan, Paragraph (b), Subparagraph [1], item b. which states "Increase the number of residential dwelling units by more than one (1%) percent. Found on page 93 of the "Land Development Guidance System for Planning Unit Developments". Since we submitted the Preliminary P.U.D. for Dakota Ridge Phase III back on June 6, 1994 and received Preliminary Approval on September 26, 1994 there has been on going negotiation with the City of Fort Collins Parks Department and Stormwater Utility Department. Within the last few weeks we have concluded the negotiation and have revised our outer boundary slightly to reflect these changes. The two different areas that were effected were the southern boundary between the park site adjacent to the new Fort Collins High School and Dakota Ridge Phase III southern boundary. The other area was on the Northwest corner of the subdivision this property transaction was between the Stormwater Utility "Foothills Basin Regional Channel; The First Assembly of God property and Dakota Ridge Phase III. Prior to final alignment of the channel the Dakota Ridge Phase III property extended into the proposed channel area abutting the "Church" -property -.— After the final alignment of the channel a "land swap" was consummated where as a triangular piece of property North of the channel was transferred to the "Church property" and a triangular piece of property on the South side of the channel was transferred to Dakota Ridge Phase III. With these two areas now finalized we were also able to slightly modify the lot layouts and were able to come up with two additional lots. These negotiations have been on going since after we brought this project to Conceptual Review back on January 24, 1994. TST, INC. November 23, 1994 City of Fort Collins Page Two of Two At the time of our Preliminary Submittal we had 74 Single Family lots and 20.73 acres which equated to 3.57 DU/Ac. At this time of Final Approval we have 76 Single Family lots on 21.11 Ac. which equates to 3.60 DU/Ac. As you can see by these adjustments, we have not significantly changed the density of the Dakota Ridge P.U.D., Third filing. We appreciate your attention to this variance.
