Services Hand Delivered Ejh Planning Department City of Fort Collins February 11, 1992 John and Lolly Clarke 706 East Stuart Street Fort Collins, CO 80525 Dear Mr. and Mrs. Clarke, Staff has not seen or reviewed the plat which Pete Delgado is working on for you, but I thought it would be helpful to convey to you what some of the City requirements are with regards to subdivision plats, given that we will have so little time to review the plat when and if it is submitted on February 12th. If you could pass along these comments to Mr. Delgado it would certainly help speed up the review process. All existing or required utility easements must be dedicated on the plat. This includes, US West, Cable TV, Light and Power, Water and Sewer, any irrigation. ditches or canals, and Stormwater Utility easements. Any existing or required street rights -of -way must also be shown. I have attached a photo copy of standard language for the Statement of Ownership, Subdivision, and Dedication, including an example of the legal description format. Engineering Staff has requested that you enter into a Development Agreement with the City. The Stormwater Utility requires the following language in the Development Agreement and on the PUD Site Plan as well: The Developer recognizes and agrees that there has existed for many years a natural or implied easement across the Property for the historic flows of Spring Creek, said easement being defined as the 100 year floodplain of Spring Creek. As a condition of approval of this Development, the Developer shall dedicate to the City an express easement for said floodplain which easement is more particularly described (and specifically dedicated) on the Plat of the Development. The City's usage of this easement shall be limited to those activities reasonably calculated to effectuate and accommodate the historic (100 year floodplain) flows of Spring Creek and no more; and in the event that the City should desire to change or increase the flows across the Property beyond historic conditions and to the injury of the Developer, the City shall pay just compensation for any such increased right. I have also attached sample signature blocks for Engineering, Planning and zoning, City Clerk,' Surveyors Certification, and Attorney's Certification, for the plat. 281 North Colle-e Avenue • P.O.
