HomeMy WebLinkAboutFORT COLLINS TRUCK SALES PUD PRELIMINARY AND FINAL - 11 92 - CORRESPONDENCE - RESPONSE TO APPLICANTDevelol !nt Services Planning Department City of .Fort Collins April 28, 1992 Mr. Charlie Meserlian 1612 Hastings Drive Fort Collins, CO. 80526 Dear Mr. Meserlian: At the April 27, 1992 regular meeting of the Fort Collins Planning and Zoning Board, the Board voted to approve Fort Collins Truck Sales, Preliminary and Final P.U.D., subject to the condition that the Development Agreement be executed within 30 days., The exact language of the condition is attached for your records. Please note that the. proposed use will not be allowed until the Development Agreement is signed and the mylars are recorded with the office of the City Clerk. The Planning Department will handle the recording details. The conditional approval does not mean that you cannot begin to clean up the property, water the landscaping, or begin interior work on the buildings. In fact, you are strongly encouraged to act swiftly'during this Spring season to nurse the long -neglected plant material back to life. Also, the property would be greatly improved by the removal of piles of tree limbs, branches, and other debris. If the Development Agreement is not signed within 30 days, the Planning and Zoning Board is empowered to grant additional time. Please contact our office if additional time is needed and you wish the Planning and Zoning Board to take the appropriate action. Box 580 • Fort Collins, CO 80522-0580 • (303) 221-6750 Developrr-nt Services Planning L-partment MEMORANDUM TO: Planning and Zoning Board FROM: Ted Shepard, Senior Planner \- DATE: April 27, 1992 RE: Condition of Approval - Fort Collins Truck Sales-#ij.-92 Because of a delay in executing the Development Agreement, the following condition must be added to the decision of Fort Collins Truck Sales, Preliminary and Final P.U.D., #11-92. Staff finds that the condition is appropriate and anticipates that the Development Agreement. will be executed within 30 days. 1. The Planning and Zoning Board approves this planned unit development final plan upon the condition that the Development Agreement for the planned unit development be negotiated between the developer and City staff and executed by the developer, and that the utility plans be fully executed and approved by the City prior to the next monthly meeting of the Planning and Zoning Board; or, if not so executed, that the developer, at said next monthly meeting, apply to the Board for an extension of time. If the. staff and the developer disagree over the provisions to be included in the Development Agreement and/or utility -plans, the developer may present such dispute to the Board for resolution if such presentation is made at the next succeeding monthly meeting of the Board. The Board may table any such decision, until both the staff and the developer have had reasonable time to present sufficient information to the Board to enable it to make its decision. (If the Board elects to table the decision, it shall also extend the term of this condition until the date such decision is made.) If this condition is not met within the time established herein (or as extended, if applicable), then the final approval of this planned unit development shall become null and void and of no effect. The date of final approval for this planned unit development shall be deemed to be the date that the condition is met, for purposes of determining the vesting of rights. 281 North College Avenue • P.O.
