Comment Summary: Department: Engineering Development Review Contact: Spencer Smith, 970-221-6603, smsmith@fcgov.com Topic: General Comment Number: 11 03/25/2020: FOR FINAL APPROVAL – UPDATED: I see that the previous Emergency Access Easement area(s) have been labeled as Drainage Easements as well. I do see a couple of other apparent adjustments to drainage easement linework to accommodate the storm pipes, but I can't clearly identify if all drainage infrastructure is contained within drainage easements from the utility plans alone. Until I have a revised plat, I cannot confirm that this comment has been addressed completely. A revised Plat is being provided. TFG Response: A revised Plat is provided and should be considered an exhibit only. It reflects the latest BDR comments but is waiting for reception numbers to be finalized. 03/03/2020: FOR FINAL APPROVAL: Please add areas of additional drainage easement for storm pipes that extend outside of the drainage easements that you currently show (see redlines). Comment Number: 12 03/25/2020: FOR DCP – UPDATED: 2 A draft of the DA has been sent to our City Attorney's Office for review. I also sent the applicant a base draft version of our DA so that the general language could be reviewed while we await the City Attorney review. I will coordinate directly once I receive comments or questions from our City Attorney. Acknowledged. 03/03/2020: FOR DCP The City will require a development agreement (DA) for this project. City staff is currently preparing a draft of this agreement and will send it to you for review as soon as it is complete. A DA information form will be sent with these comments and will need to be completed and returned to the City as soon as possible. I will be forwarding it on to our Chief Engineering Inspector for review. If there are questions, I will have him contact the engineering consultant directly. Cost estimated updated. 03/03/2020: FOR DCP We will need an engineer's cost estimate for the project to be submitted to Engineering for review by our inspections staff. This will allow us to determine what level of permitting is required for the public improvements. Please refer to the Engineering website listed in comment #12 for a template of the cost estimate (under the Development Construction Permit (DCP) section). The Development Agreement will include requirements for long-term maintenance of the onsite storm drainage facilities. We will provide you with a draft copy of the Development Agreement as soon as possible. Acknowledged. Comment Number: 21 03/30/2020: FOR FINAL APPROVAL - ESCROW: For Final Approval of the project, the City **is requesting** an escrow for the Lot Grading & Site Drainage Certifications. This escrow will be the minimum amount of $3,000. **The $200 administrative fee is waived**. The escrow is **requested** of this project because the City is not issuing the Building Permit or Certificate of Occupancy. These are our standard 3 mechanisms to obtain the as-built Lot Grading and Site Drainage Certifications. The escrow amount will be returned upon acceptance of the post-project Lot Grading and Site Drainage Certifications. **Our intent is to have a mechanism that provides assurance that the City will be able to obtain these post-project certifications. If the Grading Escrow method is not acceptable to the applicant, please suggest another mechanism that will provide the assurance that these certifications will be completed. Please feel free to contact us to discuss.** Acknowledged. Comment Number: 22 03/30/2020: FOR FINAL APPROVAL - FEES: There will be stormwater development fees and review fees. These are based on new impervious area and are typically due at the time of building permit. However, since this project will not obtain the building permit through the City, these fees need to be collected for final approval of the project. Please contact the Development Review Coordinator, Brandy, for the fee amount. Acknowledged. Comment Number: 23 03/30/2020: FOR FINAL APPROVAL: Please see the included redlines of the Utility Plans and Landscape Plans for minor comments. These include: -Minor labeling revisions. -Check grades on stormwater rundown on Rain Garden 1. -Check "Storm-5" pipe clearance from tree (due to alignment change). -Update Landscape Plan with "Storm-5" pipe location. -Add permanent erosion control to 2 storm rundowns (Rain Garden 1 and 3) and at the outlet to "Storm-5". -Update sidewalk chase detail to Fort Collins Stormwater Detail D-10: https://citydocs.fcgov.com/index.php? scope=doctype&dn=Utilities&dt=DETAIL+DRAWINGS&vid=189&q=stormwater&cmd=search All minor comments have been addressed. Note updated. 02/28/2020: FOR FINAL APPROVAL: The water service to be abandoned on the east side of the site is connected to a Fort Collins-Loveland Water District main. Please perform abandonment of 4 service per FCLWD standards and not Fort Collins standards. Update the plan notes accordingly. TFG Response: Per follow up email correspondence, the tree/utility separation conflicts have been resolved. The island tree in question was relocated to the northwest corner of the building, removing it from the proximity of the new ‘diagonal’ storm pipe. Shrubs were adjust, as well. TFG Response: Understood, thank you. 5 Department: Environmental Services Contact: Linda Hardin, , lhardin@fcgov.com Topic: General Comment Number: 2 03/31/2020: INFORMATIONAL: Fine, airborne particulate matter (fugitive dust) generated by construction related activities is considered a Criteria Air Pollutant and is regulated by federal, state, and local government due to its impact on public health and safety, and the environment. Per Section 12-153 of Municipal Code, the City’s Dust Control Manual requires that specific dust control measures are utilized for specific dust generating activities. Due to the proximity of the proposed development to existing residential area we request that, though not required, a Dust Control Plan be prepared and submitted to jkomes@fcgov.com for review. Dust Control Plan guidance is available within the City’s Dust Prevention and Control Manual at fcgov.com/dust; please contact Jason Komes at jkomes@fcgov.com with questions.
