Ok, story time:
Once there was a little project called Centerpoint Plaza. It had great aspirations to be an office building when it grew up.
By 2003, Centerpoint Plaza grew into the office building it had always dreamed of. Now, it wanted to start a family and
stand side -by -side with another office building. In 2009, Centerpoint Plaza got approval for its second office building. But
a big, bad, nasty recession prevented our protagonist from building its partner. There was hope, though. Centerpoint
Plaza had installed all of its public improvements as part of the project so all they had to do was wait for the opportune
time to build the second building. 2013 rolls around and the economy is looking a lot better. Centerpoint Plaza comes
back through the development review process to resuscitate these old plans. After years of working through the
development review process, it looks like our friendly office building was going to have its happy family after we were
ready to record their plans in 2018. But when they went to pull building permits for the second office building, they
noticed they had to replat everything to make this building work.
So now, we sit here with an approved FDP from 2018 and a recently approved BDR for the replat in July 2019. There's
really no way you would have known any of this since this was one of those outlier projects.

Hmm?
Well, it makes sense to use this replat of the first replat, but we're working on FDPs, not BDRs.
This is confusing.... Don't think we've done one like this before and not sure how to handle it. I might have to confer with
Rebecca.

Ahhh, in which case, we should use the date of recordation for the replat that we approved back in August. It was for

It's not the date we're providing notice.
If this isn't built yet, we should have probably used the future tense in the notice.
(Do they still have a legitimate extension to finish the project? It's not expired, is it?)
So, publishing vested rights is still OK now, right?
I'll revise slightly and send a new proof.

Hey Leslie,
The only thing I noticed is that it says we're providing notice on June 17, 2009. Should that be 2019?
The project isn't built. They ran into a platting issue and this project has stalled out. Generally, you can check the
building permit records by searching the subdivision name or the address. One of those methods should yield results if
they're under construction or have completed the project.
