DanaWLockwood Architect variance to the Solar Lots, Ordinance No. 142, and (29-526[d]) of the Ordinance, on Section 6 (29-627[a]), Variances, of the Ordinance allows the Planning and Zoning Board to authorize variances based on subparagraphs 1, 2 or 3. The Speights PUD is an infil project adjacent to established existing streets. The site is bounded by Timberline Road to the west and Stoney Creek Drive to the east, both are oriented north and south. Stoney Creek Drive, the street which the residential lots will access is in place. The existing street configuration represents a difficult condition orientation. Five (5) residential have been taken to orient two of orientation, the remaining three east -west orientation due to the Stoney Creek Drive. of Stoney Creek Drive with regard to solar lots are planned. Efforts these lots (40%) for solar lots are limited to existing orientation of Consistent with Subparagraph 2 of Section 6 (29-627[a]), Variances; "That by reason of exceptional conditions or difficulties with regard to solar orientation or access, hardship would be caused to a subdivider by strict application of any provisions of this Article."; and, due to the above mentioned difficult conditions, it is requested that a variance be granted to the minimum percentage (65%) of residential lots having solar orientation.
