EXECUTIVE SUMMARY:
A. Second Reading of Ordinance No. 59, 1992, Annexing Approximately 12.6

B. Second Reading of Ordinance No. 60, 1992, Zoning Approximately 12.6 acres,
Known as the Prospect Land Company Annexation, into the R-C, River
Corridor Zoning District.
On May 19, 1992, Council unanimously adopted Resolution 92-78 Setting Forth
Findings and Determinations Regarding the Prospect Land Company Annexation.
On May 19, Council also unanimously adopted on First Reading Ordinance No. 59,
1992 and Ordinance No. 60, 1992, which annex and zone approximately 12.6 acres
located on the north side of East Prospect Road, between the Orthopedic Center
and the Cache La Poudre River. The requested zoning is the R-C, River Corridor
District. The property is presently undeveloped and is zoned FA, Farming in the
County. This is a voluntary annexation.

4. The requested R-C, River Corridor District is in conformance with the
policies of the City's Comprehensive Plan.
STAFF RECOMMENDATION
Staff recommends approval of the annexation and the requested zoning.
PLANNING AND ZONING BOARD RECOMMENDATION
The Planning and Zoning Board, at its regular monthly meeting on April 27, 1992,
voted 7-0, on the consent agenda, to recommend approval of the proposed
annexation and requested zoning.

We have been working with Advanced Energy Industries, Inc., to
locate their new facility on our ground on the north side of
Prospect, west of the Poudre River. Your reference to this project
is Prospect Land Company Annexation and Zoning - #16-92.
We have not yet completed all the items that we feel are
needed prior to being comfortable annexing to the City. We
therefore request that the second and final reading approval
consideration of this item be postponed until the September 1,
1992, meeting of the Fort Collins City Council.

ORDINANCE NO. 59, 1992
OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
PROSPECT LAND COMPANY ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Resolution 92-57, finding substantial compliance and initiating
annexation proceedings, has heretofore been adopted by the Council of the City
of Fort Collins; and
WHEREAS, the Council does hereby find and determine that it is in the best
interests of the City to annex said area to the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the following described property, to wit:
Beginning at the South 1/4 corner of Section 17, T7N, R68W of the
6th P.M. in Larimer County, Colorado; thence S 89*07140" E 642.32
feet along the South line of said Section 17; thence N 00°46'30" E
618.43 feet; thence N 08°10'30" W 268.67 feet to the South line of
that tract of land conveyed to THE FORT COLLINS FOUNDATION by
PROSPECT LAND COMPANY by deed recorded in Book 1741 at Page 588;
thence S 83°19'35" W 217.08 feet along said South line; thence N
89054'00" W 395.31 feet along said South line to the West line of
the SE 1/4 of said Section 17; thence S 00°06'00" W 850.00 feet to
the Point of Beginning. Subject to any easements, rights -of -way, or
other restrictions of record specifically a right-of-way for
Prospect Avenue;
be, and hereby is, annexed to the City of Fort Collins and made a part of said
City, to be known as the Prospect Land Company Annexation.
Section 2. That, in annexing said property to the City, the City does not
assume any obligation respecting the construction of water mains, sewer lines,
gas mains, electric service lines, streets or any other services or utilities in
connection with the property hereby annexed except as may be provided by the
ordinances of the City.
Section 3. That the City hereby consents, pursuant to Section 37-45-136
(3.6), C.R.S., to the inclusion of said property into the Municipal Subdistrict,
Northern Colorado Water Conservancy District.
Introduced, considered favorably on first reading, and ordered published
this 19th day of May, A.D. 1992, and to be presented for final passage on the 1st
day of September, A.D. 1992.

AMENDING THE ZONING DISTRICT MAP CONTAINED IN CHAPTER 29
OF THE CODE OF THE CITY OF FORT COLLINS AND CLASSIFYING
FOR ZONING PURPOSES THE PROPERTY INCLUDED
IN THE PROSPECT LAND COMPANY ANNEXATION TO THE
CITY OF FORT COLLINS, COLORADO
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows:
Section 1. That the Zoning District Map adopted pursuant to Chapter 29 of
the Code of the City of Fort Collins be, and the same hereby is, changed and
amended by including the property known as the Prospect Land Company Annexation
to the City of Fort Collins, Colorado, in the R-C River Corridor District:

12.6 acres, Known as the Prospect Land Company Annexation, into the R-C,
River Corridor Zoning District.
This is a request to annex and zone approximately 12.6 acres located on the north
•side of East Prospect Road, between the Orthopedic Center and the Cache La Poudre
River. The requested zoning is the R-C, River Corridor District. The property
is presently undeveloped and is zoned FA, Farming in the County. This is a
voluntary annexation.

BACKGROUND:
The applicant, Ray Pigg, on behalf of the owner, Flatiron Companies, has
submitted a written petition requesting annexation of approximately 12.6 acres
located on the north side of East Prospect Road, between the Orthopedic Center
and the Cache La Poudre River. The requested zoning is the R-C, River Corridor
District. The property is presently undeveloped and is currently zoned FA,
Farming in the County. This is a voluntary annexation.
The property is located within the Fort Collins Urban Growth Area. According to
policies and agreements between the City of Fort Collins and Larimer County
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH
AREA, the City will consider the annexation of property in the UGA when the
property is eligible for annexation according to State law. The property gains

the required 1/6 contiguity to existing City limits from a common boundary with
the Riverbend Second Annexation to the north; the Milne Annexation to the east;
and the East Prospect Street First and the Suitts First Annexations to the west.
The surrounding zoning and existing land uses are as follows:
N: RC; vacant
S: FA ; agricultural (in Larimer County)
E: RC; Riverbend Ponds (City open space)
W: ip; Orthopedic Center (Seven Lakes PUD)
The requested zoning for this annexation is the R-C, River Corridor District.
The R-C District designation is for areas developing within the downtown river
corridor of the Cache La Poudre River. This is the proposed site for the new
Advanced Energy office and manufacturing facility, which is considered a light
industrial use.
The following policies from the City's LAND USE POLICIES PLAN apply to industrial
uses:
59. Industrial uses may locate in less hazardous flood plain classifications
provided proper mitigation of the flood hazard and water quality is
preserved and the floodplain is protected consistent with the City's Open
Space Plan and the entire project is approved by the City.
60. Industrial uses should locate near transportation facilities that offer
the required access to the industry but will not be allowed to create
demands which exceed the capacity of the existing and future
transportation network of the City.
61. Industrial development should locate within the City or consistent with
the phasing plan for the Urban Growth Area, where the proper sizing of
facilities such as water, sewer and transportation has occurred or is
planned.
This site addresses these industrial land use locational policies. Site design
and development of the site must be done with consideration of the floodplains
of Spring Creek and the Cache La Poudre River. Prospect Road is an arterial
street, providing direct access to I-25 and utilities are available to serve the
site.
The River corridor District permits light industrial uses as a use -by -right,
subject to administrative review by the Director of Planning. Review of light
industrial uses in this zone requires that the performance standards of the IL/IP
Zones be met and that landscaping meet the requirements of the LOGS.
Findings
1. The annexation of this area is consistent with the policies and agreements
between Larimer County and the City of Fort Collins contained in the
INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA.
2. The area meets all criteria included in State law to qualify for a
voluntary annexation to the City of Fort Collins.
3. On April 7, 1992, the City Council approved a resolution which accepts the
annexation petition and determines that the petition is in compliance with
State law. The resolution also initiates the annexation process for this
