This letter is in response to your request for the status of Mountain Ridge Farm, Second Filing in relation to
Ordinance No. 161, 1996 which governs the transition from the Land Development Guidance System to the
new Land Use Code.
First, although the term "Mountain Ridge Farm Second Filing" may have unofficial meaning, there is no
record of such Filing with definitive boundaries. All that our records indicate is a 59 acre Preliminary and a
14.22 acre First Filing. For purposes of this letter, therefore, we will refer to the all the area outside the First
Filing as the "balance of Mountain Ridge Farm" which you may assume to include whatever may ultimately
become the Second Filing.
Second, you are correct in that the balance of Mountain Ridge Farm is part of the 224 acre Overall
Development Plan which exceeds 100 acres. The latest amendment to this O.D.P. was approved on May 23,
1994 which precedes the effective date of Ordinance No. 161, 1996 of January 17, 1997.
Third, the balance of Mountain Ridge Farm is part of a 59 acre Preliminary P.U.D. (being a portion of the
real property covered by the Overall Development Plan) that was approved on May 23, 1994 which precedes
the effective date of Ordinance No. 161, 1996 of January 17, 1997.
Fourth, Mountain Ridge Farm First Filing, Final P.U.D. (being a portion of the real property covered by the
Overall Development Plan) was approved on June 25, 1995 which again precedes the effective date of
Ordinance No. 161, 1996 of January 17, 1997.
Therefore, under Ordinance No. 161, 1996, the owner or developer of the balance of Mountain Ridge Farm
(or the successors in interest of either such party) shall have a period of three years from January 17, 1997
within which to file with the City a Preliminary and Final P.U.D. Plan for the balance of the subject property
of the Overall Development not covered by the previously approved Final P.U.D. (Mountain Ridge Farm,
First Filing).
