Re: Mountain Ridge Farms FDPs
Dear Mr. Shepard:
On June 5, 1998, you wrote a letter to Linda Ripley (attached) explaining that final development
plans for Mountain Ridge Farms P.U.D. could be submitted under the LDG system until January
17, 2000. We have begun preparing the FDPs for 76 lots in Mountain Ridge Farms but have
run into delays with 36 lots on the west side of Seneca Street north of the Park. This delay is
being caused by proposed changes to the 100 year storm design event. Stormwater Utility is
conducting additional modeling to determine if existing and proposed detention ponds will
function properly given the new 100 year rainfall amount. The engineers in Stormwater also
indicated to us that since the detention pond sizes were approved with the preliminary plan for
this development, any changes to the ponds resulting from the new 100 year rainfall amount will
be at the City's expense and final design of Seneca St. should be put on hold until the detention
issue is resolved. This all occurred before the new 100 year rainfall amount had been approved
by council. Since Seneca cannot be designed, this delays our FDP submittal for 36 lots north
Westfield Park. We are concerned that this delay could cause us problems meeting our drop
dead date of January 17, 2000 especially if approval from Stormwater takes several months.
In order to allow Stormwater utility time to examine the detention ponds in Mountain Ridge
Farms and not jeopardize our plans, we request an extension to the January 17, 2000 deadline.
The extension should reflect the delay caused by Stormwater. Seneca Street design went on hold
as of January 21, 1999 which should be the start date for determining the time extension for the
FDP. The ending date will be whenever the detention issue is resolved.
Please let us know if you can grant this extension as it is very important to our development
plans. If we loose our preliminary approval, we will be forced to go through a new development
approval process which will be very costly and time consuming.
