P. and Thanet S. Michaels 1743 Nedrah Drive Fort Collins, CO 80524 OWNER: Marvin Fries 1137 Riverside Fort Collins, CO 80524 PROJECT DESCRIPTION: This is a request for an appeal of an administrative decision to approve a Minor Subdivision, located at 1137 Riverside, zoned I-G, General Industrial and B-P, Planned Business. RECOMMENDATION: Uphold approval of the Minor Subdivision EXECUTIVE SUMMARY: On June 2, 1992 the Director of Planning approved the Fries Enterprises Building Minor Subdivision request, which was to create a 1.6 acre one lot Minor Subdivision. The purpose of the Minor Subdivision is to create a legally subdivided lot under the existing building at 1137 Riverside, as required by the Zoning Code. An appeal of the administrative approval of this Minor Subdivision has been filed by the Michaels, owners of the B&M Roofing Site, located to the west of the Fries Enterprises Building site. Background: Minor Subdivision Appeal - #15-92 Z Meeting on June 2, 1992 the Director of Planning approved the Fries Enterprises Building Minor Subdivision request, which was to create a 1.6 acre one lot Minor Subdivision. The purpose of the Minor Subdivision is to create a legally subdivided lot under the existing building at 1137 Riverside, as required by the Zoning Code, due to a change in use at this location. The change of use occurred with the location of Autobahn West, an auto repair shop, in the existing building. Auto repair is a permitted use in the I- G, General Industrial Zone, which is the zoning on that portion of the property that includes the existing building. In approving this Minor Subdivision, the Director of Planning adopted the following findings: A. The proposal meets the design criteria and standards of the City for streets and utilities. B. The lot in this subdivision fronts on a dedicated right-of- way. C. The lot is consistent with, and meets the requirements of the I-G, General Industrial and B-P, Planned Business Zoning Districts. An appeal of the administrative approval of this Minor Subdivision has been filed by the Michaels', owners of the B&M Roofing Site, located to the west of the Fries Enterprises Building site. The Minor Subdivision section of the City Code provides for appeals of administrative decisions. Such appeals must be filed by a party - in -interest within seven days of the decision. The appellants, as adjacent property owners, are parties -in -interest and the appeal was filed on June 3, the day after the approval decision was made. The appeal is based on concerns regarding access and multiple curb cuts on Riverside Avenue (see attached). RECOMMENDATION The Fries Enterprises Minor Subdivision meets the City's design criteria and standards for streets and utilities and the lot fronts on a dedicated right-of-way. All Zoning Code requirements for the I-G and the B-P Zoning Districts have been met. Therefore, staff recommends that the Planning and Zoning Board uphold the approval of the Fries Enterprises Building Minor Subdivision, 015-92. No Text r4
