RECOMMENDATION:
Staff recommends approval of the annexation and zoning request. The Planning and
Zoning Board voted 6-0 to recommend approval of the annexation and requested
zoning.
EXECUTIVE SUMMARY:
A. Second Reading of Ordinance No. 80, 1992, Annexing Approximately .3848
Acres, Known as the Burns Second Annexation.
B. Second Reading of Ordinance No. 81, 1992, Zoning Approximately .3848
Acres, Known as the Burns Second Annexation, into the R-F, Foothills
residential, Zoning District.
On July 7, Council unanimously adopted Resolution 92-102 Setting Forth Findings
of Fact and Determinations Regarding the Burns Second Annexation.
On July 7, Council also unanimously adopted on First Reading Ordinance No. 80,
1992 and Ordinance No. 81, 1992, which annex and zone approximately .3848 acres
located west of Overland Trail and south of West Drake Road. The requested zoning
is the R-F, Foothills Residential, District. The property is presently
undeveloped. The property is currently zoned FA-1 Farming in the County. This
is a voluntary annexation.

This is a request to annex and zone approximately .3848 acres located west of
Overland Trail and south of West Drake Road. The requested zoning is the R-F,
Foothills Residential, District. The property is presently undeveloped. The
property is currently zoned FA-1 Farming in the County. This is a voluntary
annexation.

BACKGROUND:
The applicant, Rex Burns, on behalf of the owners, Burns Ranches, Inc., has
submitted a written petition requesting annexation of approximately .3848 acres
located west of Overland Trail and south of West Drake Road. The requested zoning
is the R-F, Foothills Residential, District. The property is presently
undeveloped. The property is currently zoned FA-1 Farming in the County. This
is a voluntary annexation.
The property is located within the Fort Collins Urban Growth Area. According to
policies and agreements between the City of Fort Collins and Larimer County
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH
AREA, the City will consider the annexation of property in the UGA when the
property is eligible for annexation according to State law. The property gains

the required 1/6 contiguity to existing city limits from a common boundary with
the Burns Annexation to the south and the Quail Hollow Annexation to the east.
The surrounding zoning and existing land uses are as follows:
N: FA-1 Farming, undeveloped.
E: R-L-P, Low Density Planned Residential, single-family subdivision.
S: R-F, Foothills Residential, undeveloped large -lot subdivision.
W: FA-1 Farming, undeveloped.
The requested zoning for this annexation is the R-F, Foothills Residential,
District. The R-F District designation is for large -lot residential development
while protecting the open space and natural environmental features of the
foothills area. The property will eventually develop as an access road to the
Burns Ranch Single -Family Large Lot Subdivision. The proposed development is
consistent with the City's LAND USE POLICIES PLAN and the policies contained
within the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA.
Findings
The annexation of this area is consistent with the policies and agreements
between Larimer County and the City of Fort Collins contained in the
INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA.
2. The area meets all criteria included in State law to qualify for a
voluntary annexation to the City of Fort Collins.
3. On May 19, 1992, the City Council will passed Resolution 92-79 which
accepted the annexation petition and determined that the petition is in
compliance with State law. The resolution also initiated the annexation
process for this property by establishing the date, time and place when a
public hearing will be held regarding the readings of the Ordinances
annexing and zoning the area.
4. The requested R-F, Foothills Residential, District is in conformance with
the policies of the City's Comprehensive Plan.
PLANNING AND ZONING BOARD RECOMMENDATION:
The Planning and Zoning Board, at its regular monthly meeting on May 18, voted
6-0 to recommend approval of the Burns Second Annexation and R-F, Foothills
Residential, Zoning request as part of the Board's Consent Agenda.
