Hussey PROJ #: FC0114 SUBJECT: Phone Conversation with U.S. Army Corps of Engineers — Terry McKee On March 13, 2000 Michael Hussey sent Wetland Mitigation Plans for the proposed improvements to the Best Buy Store #225, located in Fort Collins, Colorado to Mr. Terry McKee of the U.S. Army Corps of Engineers (the Corps) for his review and comment. Mr. McKee called Mr. Hussey on March 20, 2000 with some initial comments, which follow. • Mr. McKee considers the wetlands impacted by this project to be "Waters of the U.S." • Because this wetland is considered to be Waters of the U.S., it cannot be disturbed without applying for and receiving a Nationwide Permit. • Because the Nationwide Permit is undergoing revision, the Corps cannot accept impact applications on any wetland larger than 1/3-acre until June 7, 2000. The affected wetlands are 20,090 square feet in size (nearly 1/2-acre). Therefore, the wetlands cannot be touched until June 7, 2000. • As of June 7, 2000 the Corps will accept applications for Department of Army Nationwide Permit #39. • Based on the Wetland Mitigation Plans submitted by Nolte Associates on March 13, 2000 to Mr. McKee, he feels that the Corps will issue a Nationwide Permit #39 that will allow for impacts'to these wetlands as proposed. nAfc01 Musarmycorpsphonedocum l .doc
