Once all the other departments have what they need to draft language for the Development Agreement, I will be able to compile a draft for the City Attorneys Office to review, and then to the applicant team to review. 01/28/2020: Development Agreement: Please submit the information sheet for a Development Agreement to me or in the next round of review. Once comments from all contributing departments have been resolved I can put a draft together and have the City Attorneys office review it. Once the City Attorney's review the draft, I will send it to the applicant for review. After the draft is accepted by both parties, we can work through the details for finalizing and getting the Development Agreement recorded at the County. This will require an encroachment permit. Feel free to contact me with any questions. 3 01/28/2020: FOR FINAL APPROVAL: For this project, we will allow both buildings to be served from the existing water and sewer service (the existing 'building' is being separated by the removal of an enclosed walkway). This is an exception and not a precedence for what we will permit elsewhere. The applicant will need to sign a covenant agreement that states the property cannot be subdivided in manner that would place these buildings on separate lots. **Update: The covenant agreement form will be filled out by Utilities and sent to the applicant at FDP round 2 for review. This will need to be signed by the applicant and filed with the County. I have included the blank template of the covenant agreement with the redlines. The installation of security gates across a fire apparatus access road shall be approved by the fire chief. Where security gates are installed, they shall have an approved means of emergency operation. The security gates and the emergency operation shall be maintained operational at all times (IFC 503.6). > IFC D103.5: Gates securing fire apparatus access roads shall comply with all of the following criteria: 1. The minimum gate width for vehicle access shall be 20 feet. 2. Gates shall be of the swinging or sliding type. 3. Construction of gates shall be of materials that allow manual operation by one person. 4. Gate components shall be maintained in an operative condition at all times and replaced or repaired when defective. 5. Electric gates shall be equipped with a means of opening the gate by fire department personnel for emergency access. Emergency opening devices shall be approved by the fire code official. Gates must have a Knox Gate Key Switch that fits the Knox Key system for Poudre Fire Authority. 6. Gate design and locking device specifications shall be submitted for approval by the fire code official prior to installation. 7. Electric gate operators, where provided, shall be listed in accordance with UL 325 and have a means of emergency, manual operation during power loss. 8. Gates intended for automatic operation shall be designed, constructed and 4 installed to comply with the requirements of ASTM F 2200. Response: Vehicle Gate detail has been provided on Sheet L2.
