01/27/2020: FOR MYLAR: On the site plan, please call out the location where
the 6 foot fence ends and the 4 foot fence begins along the east boundary. Per
code, the 6 foot fence should stop at the "front building line" of the adjacent
building to the east and transition to 4 feet. That said, we would be OK with the
4' fencing turning the corner, extending along just a portion of the side property
line and then transitioning to 6 feet somewhere in the front yard to allow more
screening flexibility, generally as shown on the architectural elevations. If there's
an issue or question, please feel free to reach out to me.
Response: The 6’ privace fence has been pulled north 20’ to align with the edge of the gravel drive.

01/28/2020: Development Agreement:
Please submit the information sheet for a Development Agreement to me or in
the next round of review. Once comments from all contributing departments
have been resolved I can put a draft together and have the City Attorneys office
review it. Once the City Attorney's review the draft, I will send it to the applicant
for review. After the draft is accepted by both parties, we can work through the
details for finalizing and getting the Development Agreement recorded at the
County.
Response: Development Agreement information has been submitted.

It appears that a new gate is being installed at the driveway to this property off

out of the right-of-way and the gates for the vehicles and pedestrians can not
swing into the right-of-way.
Response: Gate has been moved out the right-of-way. Gates will swing inward to the property.

A temporary construction easement will be needed from the neighbor to the
north where the retaining wall and the fire lane will be crossing the property. This
is a private agreement, so we will just need to see the executed agreement.

For this project, we will allow both buildings to be served from the existing water
and sewer service (the existing 'building' is being separated by the removal of
an enclosed walkway). This is an exception and not a precedence for what we
will permit elsewhere. The applicant will need to sign a covenant agreement
that states the property cannot be subdivided in manner that would place these
buildings on separate lots.
**Update: The covenant agreement form will be filled out by Utilities and sent to
the applicant at FDP round 2 for review. This will need to be signed by the
applicant and filed with the County. I have included the blank template of the
covenant agreement with the redlines. Please review and let us know if there
are any issues or objections. Any questions on this can be directed to Jill White
at UtilityFees@fcgov.com.
Response: Executed covenant agreement will be provided.
