SUBJECT:
Resolution 92-163 Stating Intent of the City of Fort Collins to Annex Certain
Property and Initiating Annexation Proceedings for Such Property to be Known as
the Phillips Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The property being considered for annexation is approximately 1.73 acres in size
and is located approximately 150' west of I-25 on the north side of East Prospect
Road. The property is located within the Urban Growth Area. The annexation is
comprised of three parcels under separate ownership. The property is currently
vacant and zoned C, Commercial, in the County. The proposed zoning for this
annexation is H-B, Highway Business with a Planned Unit Development (PUD)
condition. Surrounding properties to the north, east and west are zoned H-B,
with a PUD condition. The property to the south is zoned R-C, River Corridor.
The proposed Resolution determines that the annexation complies with the
Municipal Annexation Act and the Intergovernmental Agreement for the Fort Collins
Urban Growth Area, determines that a hearing should be established regarding the
annexation, and directs that proper notice be given of the hearing. The hearing
will be held at the time of first reading of the annexation and zoning ordinances
on December 15, 1992.
BACKGROUND:
The property is located within the Fort Collins Urban Growth Area. According to
policies and agreements between the City of Fort Collins and Larimer County
contained in the Intergovernmental Agreement for the Fort Collins Urban Growth
Area, the City will agree to consider annexation of property in the UGA when
the property is eligible for annexation according to State law. The property
became eligible for annexation as an enclave on April 4, 1992, the date it became
completely surrounded by the City for a period of at least three years. The
property became completely surrounded by the City of Fort Collins through the
following annexations:
N: Interstate Lands First Annexation, April 4, 1989;
E: Interstate Lands First Annexation, April 4, 1989;
S: Sludge Farm Annexation, June 7, 1988;
W: Interstate Lands First Annexation, April 4, 1989.

The annexation is made up of three parcels under separate ownership. The owners
are as follows:

Planning and Zoning Board Recommendation:
The Planning and Zoning Board will conduct a public hearing on the annexation and
zoning request at its regular monthly meeting on November 16, 1992. The Board's
recommendation will be forwarded to the City Council in time for first readings
of the ordinances annexing and zoning the area, scheduled for December 15, 1992.
RESOLUTION 92-163
OF THE COUNCIL OF THE CITY OF FORT COLLINS
STATING THE INTENT OF THE CITY OF FORT COLLINS
TO ANNEX CERTAIN PROPERTY AND
INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY
TO BE KNOWN AS THE PHILLIPS ANNEXATION
WHEREAS, the property hereinafter described has, for a period of not less
than three (3) years prior to this date, been completely contained within the
boundaries of the City of Fort Collins; and
WHEREAS, the Council desires to initiate annexation proceedings in
accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That, the Council of the City of Fort Collins intends to annex
the following described property, to be known as the Phillips Annexation, situate
in the County of Larimer, State of Colorado, to wit:
A tract of land situate in the Southeast Quarter of Section 16,
Township 7 North, Range 68 West of the 6th P.M., Larimer County,
Colorado, which considering the South line of the Southeast Quarter
of said Section 16 as bearing N 8°38'25" W and with all bearings
contained herein relative thereto is contained within the boundary
lines which begin at the Southeast corner of said Section 16 and run
thence N 8°38'25" W 972.00 feet; and thence N 00°04'55" W 30.00 feet
to the true point of beginning; thence N 88'38'25" W 210.00 feet;
thence N 00°04'55" W 200.00 feet; thence S 88°38'25" E 410.00 feet;
thence S 00004'55" E 155.00 feet; thence N 88°38'25" W 98.08 feet;
thence S 67'08'05" W 109.70 feet; thence N 88°38'25" W 0.75 feet to
the point of beginning.
Containing 1.7284 acres.
Section 2. That the Council hereby initiates annexation proceedings for
the above -described property.
Section 3. That the Notice attached hereto be adopted as a part of this
Resolution. Said Notice establishes the date, time and place when a hearing will
be held regarding the passage of an annexation ordinance pertaining to the above
described property. The City Clerk is directed to publish a copy of this
Resolution and said Notice as provided in Section 31-12-108(2), C.R.S.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 3rd day of November, A.D. 1992.

TO ALL PERSONS INTERESTED:
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has
adopted a Resolution initiating annexation proceedings for the Phillips
Annexation, said Annexation being more particularly described in said Resolution,
a copy of which precedes this Notice.
That, on December 15, 1992, at the hour of 6:30 p.m., or as soon thereafter
as the matter may come on for hearing in the Council Chambers in the City Hall,
300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City Council will
hold a hearing for the purpose of finding and determining whether the property
proposed to be annexed meets the applicable requirements of Colorado law and is
considered eligible for annexation.
