Enclosed is the plat for the Phillips Annexation. After I had
the new plat prepared I discovered that in March 1991 I had
prepared a plat for this same area. In the interim, the County
has researched the ownership of what was originally called a 60
foot road right-of-way separating two parcels, and they now
conclude that although the 60 foot section of property was
deeded for public right-of-way by a dedication deed (B-1303, P-
507) from Leroy K. Smith on September 3, 1965, the County has
never accepted the property, and therefore they conclude the
property is still owned by the previous owner, Leroy K. Smith.
I have modified the plat to reflect this change.
Mr. Smith is deceased, and to the best of my knowledge his
daughter and son-in-law, Thomas Basset and Charlene Basset,
whose address at the Assessor's office is 3500 Carlton Ave. #W-
52, Ft. Collins, CO 80525, are trustees of his estate. I
believe the County is now planning to contact them to see what
they would like to do with this matter, but for the moment it
appears that the property is owned by Smith or his estate.
