Dear Jim,
I have spoken with Paul Eckman, in the City Attorney's office, and
Ron Phillips, interim City Planning Director, to discuss the Fossil
Creek Estates PUD. We have concluded that the preliminary PUD, as
approved by the Planning and Zoning Board on Thursday December 16,
1993, is valid with the conditions as stated in the minutes of the
meeting. An approval letter will be sent to you spelling out those
conditions.
The eastern portion of the PUD, which was annexed to the City of
Fort Collins as the Wuerker Annexation, and zoned rlp, with a PUD
condition, has satisfied the condition relating to zoning of the
preliminary PUD. Therefore, it would be appropriate to submit a
Final PUD on Phase one, provided that all portions of the final are
in fact annexed and zoned rlp.
