Re: Front Range Storage – PDP230011, Round 2 LWIC Comment Responses
Dear Ms. Pomerleau,
On behalf of the Applicant for the Front Range Storage project, we submit the following
responses to comments provided by the Larimer and Weld Irrigation Company (LWIC) and
Ecological Resource Consultants, LLC (ERC) regarding the Preliminary Development Plan
(Round 2). We appreciate the opportunity to address these items and provide clarification.
1. Easement and Access
A portion of the 1974 LWIC easement falls within the limits of the proposed RV & Boat Storage
facility. That portion will be vacated by separate document, and a new access easement will be
dedicated to ensure LWIC’s continued access to the Canal. The realignment is reflected on the
Utility Plans. LWIC will maintain 24-hour access to the Canal during construction, including for
heavy equipment.
2. Stormwater Discharge
No developed runoff from the project will be discharged into the LWIC Canal. All onsite runoff,
as well as upstream runoff north of the site, will be conveyed to Boxelder Creek, the natural
drainage for this basin. Runoff from Tract D will also be routed to Boxelder Creek. The final
design includes no detention facilities adjacent to the LWIC Canal and no developed runoff into
the Canal.
3. Drainage and Utility Plan Details
The existing culvert in the NEWT III waterline easement will remain in place, as no
grading is permitted within that easement. This culvert will only capture runoff from a
small undeveloped area and convey no developed runoff.
All developed runoff north of or within the outfall channel is being routed to Boxelder
Creek.
No grading or permanent improvements are proposed within a minimum of 60 feet of the
LWIC top of bank.
4. Trail and Public Access
The regional trail previously shown along the south side of the property has been removed. No
public trail is proposed adjacent to the Larimer and Weld irrigation canal per the request of
LWIC.
5. Construction Dewatering
If any construction dewatering is required, discharge will be routed to Boxelder Creek. No
construction dewatering will be discharged into the LWIC Canal.
6. Documentation and Plan Updates
Adding an LWIC signature block to the cover sheet would suggest that improvements
directly impact LWIC facilities, which is not the case. Aside from the vacation/dedication
of the access easement which will be done by separate document, no improvements affect
LWIC.
The Applicant acknowledges LWIC’s prescriptive easement adjacent to the Canal but has
not received a request or specific language from LWIC to plat a permanent easement.
A significant effort by PEC and JR Engineering has ensured that LWIC will not receive
developed runoff from this site or future upstream development, achieved through
construction of a large outfall channel routing flows to Boxelder Creek.
All final plans will be signed and stamped by a Professional Engineer registered in the
State of Colorado.
Conclusion
The Applicant has carefully addressed LWIC’s and ERC’s concerns by eliminating stormwater
discharges into the LWIC Canal, preserving access, removing the trail, and clarifying
construction and documentation commitments. We understand the access easement vacation and
dedication will need to be finalized before the project can be fully approved, but most we believe
these measures fully resolve the outstanding issues and respectfully request acknowledgment that
LWIC’s requirements have been satisfied.
