Miller and Company APR 19 1977 Suite 101 1635 Blue Spruce Drive Fort Collins, Colorado 80521 Dear Mr. Robinson: Enclosed please find a copy of our letter to Mr. Kaplan, Planning Commission Director for the City of Fort Collins, concerning our recent meeting. Hopefully, ! it meets your needs. Enclosed also are copies of the legal descriptions Mr. Jackson left at our office for our review. It is our request that the proposed frontage road along the north side of the proposed Expressway be ended at Red Cedar Drive as per our conversation that access to US 287 be via Bristlecone Drive. Our Right-of-Way Section reviewed the legal descriptions and plat and found two minor items to be clarified. In the legal description of Parcel F, the dimension of 275.92 feet on the northeasterly course of the centerline of Conifer Street is shown as 275.02 feet on the plat. Also, points of beginning should be marked on the plat. Please revise and re-submit two copies of the corrected documents for our files. Other than the above, the documents are acceptable. Box 580 F,I Fort Collins, Colorado 80522 � ` ` Department Dear Mr. Kaplan: This letter is written to inform your office of what was discussed during a meeting with Messrs. Steve Robinson (Project Manager) , Fritz Jackson (Engineer for Evergreen Park) , Dwight Bower (District Engineer) , Ralph Finch (District Design Engineer) , and myself (District Utility Engineer) concerning reservation of right of way for the Fort Collins Central Expressway through Evergreen Park. Mr. Jackson left a copy of legal descriptions for parcels to be included in the above reservation. The Division found them acceptable with only minor revision needed. Mr. Robinson requested that we write this letter to clarify the wording in our letter to you on February 28, 1977. The Division may have overemphasized that the Expressway was only a proposal . The District has full intentions of constructing the Expressway through the Evergreen Park area at such time funds become available. At this time, no precise date can be tied to the above. The area reserved for highway use is adequate for the presently proposed alignment and design. Mr. Robinson has assured us that development will not encroach into this reserved area. Mr. Bower requested that the proposed frontage road along the north side of the proposed Expressway not be continued to North College and that it end by tying into Red Cedar Circle. Traffic would then be circulated through the existing street system to North College via Bristlecone Drive. Mr. Robinson had no objections to this proposal . The District would like to make comment that we would suggest due considera- tion be given to allowing the developer to exchange zonings: zoning within the reserved area to be exchanged with a like area outside the strip. Our reasons are that the District has intentions of constructing the Expressway, thus capturing this zoning. Mr. Robinson also stated there was a possibility that this property may change ownership again. It would be our specific recommendation that some thought be given as to how the past negotiations were made binding on the property. This would hopefully eliminate further confusion on the matter. 4 Larimer County US 287 Evergreen Park DOH FILE 04-41 MR.
