RE: Lots 1 & 2 Swallow Subdivision-Round the Corner-Long
John Silvers
Dear Paul:
My wife and I have sole ownership of the captioned property as
tenants in common by the terms of the lease that we have negotiated
with Long John Silvers Restaurants. We are obligated to provide
cross-easements for ingress and egress between the two lots. We
plan also to have cross-parking easements between the two lots. My
attorney, David Wood, advises that any easement that would be created
until the buildings, landscape, perimeter fences, and any other perm-
anent obstructions are put in place, would be a "sloppy" easement.
The better way is to have a final "as built" survey and attach such
survey to the instrument creating the easement.
This letter is to certify that Edna P. Williams and Jack H. Williams
will, upon the completion of the improvements, order an "as built"
survey and will have the above mentioned easements drawn up by
Mr. Wood and record same. Please be assured that both our tenants
and ourselves are much more concerned about the free flow of traffic
in and out of these parking lots than is the City. You are only
concerned with traffic problems, we are concerned with the economics
of having satisfied customers.
