Easement Variance Request
June 23, 2023
1.Issue: Pedcor Investments is requesting a variance request to incorporate notches into the
standard ROW easements along International Boulevard, Aria Way, and Donella Drive at cer-
tain buildings. Along International Boulevard these are buildings 13 and 14, along Aria Way
they are buildings 4, 7, 9 and 13, and along Donella Drive it is building 1. During the planning
process we had to move buildings close to the easement line, and add on patios in a few ar-
eas, not to mention having to place buildings tight to the parking lots to accommodate Poudre
Fire Authority access. This left us little room to place mechanical equipment (heat pumps).
We have a few of these pads encroaching into the easements, as well as some first floor roof
overhangs, and in the case of building 14, a slight foundation encroachment. None of this ac-
tually affects utility placement, but we would like to notch out the utility easements to avoid
any legal encroachments.
2.Alternate Design: The notches in the utility easements are as noted below, and shown on
the following attachments.
Building 1: Along Donella Drive, notch out the easement 4 feet deep, by 30 feet wide (cen-
tered on the building) to accommodate first floor roof overhang at the porches. This leaves
an easement width of 5 feet.
Building 4: Along Aria Way, notch out the easement 2.5 feet deep by 100 feet wide (cen-
tered on the building) to accommodate first floor roof overhangs and heat pump pads. This
leaves an easement width of 6.5 feet.
Building 7: Along Aria Way, notch out the easement 3 feet deep by 144 feet wide (centered
on the building) to accommodate first floor roof overhangs and heat pump pads. This leaves
an easement width of 6 feet.
Building 10: Along Aria Way, notch out the easement 2.5 feet deep by 100 feet wide (cen-
tered on the building) to accommodate first floor roof overhangs and heat pump pads. This
leaves an easement width of 6.5 feet.
Building 13: Along Aria Way, notch out the easement 3 feet deep by 144 feet wide (cen-
tered on the building) to accommodate first floor roof overhangs and heat pump pads. This
leaves an easement width of 6 feet.
Building 13: Along International Blvd, notch out the easement 3 feet deep by 50 feet wide
(centered on the building) to accommodate first floor roof overhangs. This leaves an ease-
ment width of 12 feet.
Building 14: Along International Blvd notch out the easement 2.5 feet deep by 136 feet
wide to accommodate first floor roof overhangs, heat pump pads, and a slight foundation
encroachment on the east corner of the buildings. This leaves an easement width of 12.5
feet.

3.Comparing to Standards: There is minimal impact on the standard as utilities (typically gas
lines in these easements) can still be installed. Most of the encroachments of the easement
are minor utility pads, or first floor roof overhangs, neither of which would preclude typical util-
ity installations. Easements do still exist, just slightly narrower in some areas. There are no
impacts on capital or maintenance requirements due to this variance request.
4.Justification: This variance request reduces standard ROW easement widths in a few loca-
tion as outlines above. This will not be detrimental to the public health, safety, and welfare as
an easement will still exist, just slightly narrower, and typical utilities that are installed in these
easements can still be installed. This variance will have no impact on the design life of the
improvements, nor will the City of Fort Collins incur additional maintenance costs. The pro-
posed plan (as varied, advances the purpose of the standard utility easement equally well or
better than compliance with such standard.
