Upon execution of a water service agreement (if necessary),payment of all associated fees,satisfaction of all development,raw water dedication, design and review requirements, installation of on and offsite infrastructure, and acceptance of all improvements by the District,the District will provide water service to the Property,upon and subject to the satisfaction of all requirements stated below. The current or any subsequent developer("Developer")will satisfy all requirements solely at Developer's cost. Any replat of any part of the Property following the issuance of this letter will require a review by ELCO staff that may result in changes to ELCO's commitment to provide service or the need to re-issue this letter. 1. All water system improvements and other requirements described below will have been completed by the Developer according to ELCO's rules, regulations, standards, specifications and AWWA standards so that ELCO will have facilities available to provide treated water service to the Property. All such improvements must be inspected and accepted (to the extent they are dedicated to ELCO),by ELCO,before service will be provided. 2. All parcels within the proposed project that are to be served by the District are,or will have been,included within the District service area. 3. The Developer will have installed new water lines that connect to existing District facilities located near or running through the Property. The exact location and sizing of those new water lines will be determined and depicted on utility plans for the development of the Property. Some new water line installations may require easement dedications and off-site improvements. If required, Developer will have installed all required offsite improvements and obtained all required easements. ❑ 4. If this box is checked,the District's obligation to provide water service to the Property is conditioned upon the District's completion of the following: In addition, prior to the activation of any District water service to the Property, the following requirements must be satisfied: 232 South Link Lane,P.O. All associated raw water requirements must be met by the Developer and the associated PIF,meter,inspection and tapping fees must be paid for the service. Following the installation of the required waterline improvements described above, District facilities that will serve the Property will meet the public water supply requirements set forth in Section 4.3.7.of the Larimer County Land Use Code. Fire flows from waterlines that will serve the Property will meet the minimum fire flow requirements set forth by Poudre Fire Authority. A District evaluation of the proposed water use will be required to ensure appropriate backflow prevention assemblies are installed on water service and fire lines. In addition,periodic District inspections of backflow prevention assemblies installed on water service and fire lines may be required to ensure compliance with current District Rules and Regulations. All backflow prevention assemblies required by the District must be tested annually with test results provided to the District. This commitment to provide water service to the Property is valid for two(2)years from the date of this letter. If water service has not been activated within that period of time,this commitment to serve letter expires and will require a re-evaluation of the District's ability to provide water service.
