Note:
The Developer, or its successor(s) in interest, shall be
responsible for the ongoing irrigation and maintenance of the
landscaping located within the public right‐of‐way along the
portions of W. Prospect Road & S. Overland Trail that abuts
the Property as shown on the Final Development Plan
Documents. This obligation may be assigned to a home
owners association duly constituted pursuant to Colorado state
law, however, should such home owners association be
dissolved, the obligation shall become that of the Developer or
its successor(s) in interest.
