I have no further comments on the construction plan set as sent. I think what's needed now is to finalize the Crossing Agreement, get all parties to sign the Agreement, attach a FINAL
set of construction plans and the hydraulic calculations (PE Stamped and Signed), collect the crossing fees, and record the documents at the County.

Please find attached the ditch section from the construction documents.
Items of note:
These are from the Set submitted to the City for which they didn’t have comments.
These are not signed as we haven’t signed or completed the CD set with the city to have a signed set.
If needed I can provide the hydraulic calcs if needed for the ditch agreement (they were previously provided and approved).
Let me know if you have any additional items needed.

Please see below. It appears your client has requested Mr. Pless to pass on responses to my questions and construction plans (revised?). However, the mentioned link was missing
in the forwarded message I received from the North Louden's lawyer.
Could you send me the relevant construction plans so I can again verify and communicate back to the ditch? I appreciate your responses to my questions (the red below). As we're
basically at 2024, I should remind everyone that these proposed changes to the ditch will need to be constructed before irrigation season resumes in the Spring.

James,
I met Tuesday with the North Louden Board president. We went over the 10/14/22 Final Utility plan and profile that was provided to me in April. We had a few questions and requests
for the final plan set (when issued).
Question 1: That 10/14/22 plan doesn't appear to show the headgate for the Victoria Estates lateral. This would be approximately near the end of the existing ditch where it goes
into the 36-inch ADS near survey point 13+00. That headgate serves properties to the northeast. It was surveyed late last year so the key information should be available. IRR D-6
Headwall with gate is shown on C.7 and detailed on C7.4-C7.5
We want that and all headgates shown more clearly on the final plan set that will be recorded with the County when the agreement is finalized. Please call out the inverts,
show the extents (width and length) of all the ditch easements. Labels have been added and details are reference and included on C7.4-C7.5 The easements are shown throughout the irrigation
sheets.
Question 2: There's a small pond/swale near the south end of the realigned ditch-pipe system (approx 20+00 on the profile). What provision is there for any overflow of this feature.
Overflow spillway is shown on C7.0
For the final plan set (to be recorded), we request that detail drawings be provided for the pipe system inlet trash racks, inlet and outlet erosion protection for all pipes, and
all headgates, whether existing to remain or new. As this will be a residential development fencing should be shown on the drawings. An access road running parallel to the open ditch
sections will be needed to allow both the ditch company or HOA to perform inspections, maintenance, and repairs. See detail sheets C7.4-C7.5
We will request that the agreement, that is still in negotiation/draft form, will include requirements that the HOA be responsible for installing and mowing turf grass in the sections
of open ditch. Going native invites weed growth and erosion problems increasing maintenance needs like Spring pre-flow burning of weeds and cattails. Having grass obviates those problems.
The agreement will also include requirements that the ditch company and HOA perform annual pre-irrigation season inspections of the proposed realigned pipe-ditch system to identify
any needs. The HOA will need to perform regular maintenance including frequent trash and debris cleanups to prevent these materials from entering the pipe system.
The requests for items and agreement clauses stated above will be pointed out to the ditch's legal representative for his negotiations with the developer's legal team.
