Tree Removal Justification
Lot 5 is the last remaining lot in the Prospect Park East P.U.D. Originally developed in the
1980s, the business park has become a successful mixed-use site for a variety of public
services, schools, offices and medical facilities shaped by the East Prospect Corridor Plan.
The intent of section 3.2.1 of the Land Use Code is plans to ensure significant canopy cover is
created, diversified and maintained so that all associated social and environmental benefits
are maximized to the extent reasonably feasible. The majority of th e existing trees on the
Prospect Sports site will be protected in place. In these areas where protection is not feasible
with the development of the lot, trees will be replaced according to the requirements of the
Land Use Code.
Lot 5 is a long, narrow lot with street frontages on two sides and existing development on the
adjacent parcels. Given the small size and configuration of the lot, development of this lot is
not feasible without some impact to existing trees on the property. There is a significant tree
buffer along both streets, the west property line and within the middle of the site. The
proposed building and parking have been configured to protect as many trees as feasible ,
prioritizing protection of the landscaped perimeters of the property. But there are two
locations where trees will be impacted: an existing cluster of trees near the middle of the
property and a few individual trees impacted by required utility connections or the required
emergency vehicle access to East Prospect Road . Since all of the existing trees have been on
this property for many years, they are large and each have relatively high mitigation values.
The tree mitigation details are included in the Mitigation Plans. Of the 49 trees existing on the
site, 40 are planned to be retained and protected and 9 removed. The mitigation
requirements for these 9 trees equals 21 new replacement trees. Since the property is small
and already contains a large number of trees , we have indicated as many trees as possible to
meet the Land Use Code requirements while maintaining the spacing recommendations in
the code. 23 new trees are proposed on the development site. The property owner also owns
the parcel of land immediately east of the site and has indicated interest in planting the
remaining mitigation trees on this nearby property unless the City has a preferred location.
