As you know there is a nest pole just to the east of Sharp Point Dr that is used every year by osprey. The nest has not been occupied by any other species of raptor that CPW is aware of. Over the last several years, the nest has only been occupied by osprey. CPW in consultation with the US Fish and Wildlife Service has developed recommendations on ways to avoid and minimize disturbance to raptor nests through both temporal and spatial buffers or restrictions. CPW also recognizes and acknowledges that some raptors tolerate human activity more than others and in these cases CPW may eliminate or adapt temporal restrictions and or spatial buffers. CPW looks at each nest individually and takes a holistic approach to determine the best recommendations for the conservation of raptors. The general temporal and spatial recommendations for osprey are as follows: • No surface occupancy within 1/4 mile radius of an active nest. • No permitted, authorized, or human encroachment activities within 1/4 mile radius of active nests from March 15 through August 15. CPW is very familiar with the osprey nest to the east of this project and the nest is occupied annually by osprey. The project site also falls within the 1/4 mile buffer radius recommended for osprey. The nest is just off Prospect Rd, which is a heavily travelled road in Fort Collins. The nest is located on private property and is also adjacent to three Fort Collins natural areas- Cottonwood Hollow, Riverbend Ponds, and Running Deer Natural Areas. All of these areas are heavily used by the residents of Fort Collins year round, but especially 2 during the summer nesting season. Additionally, the nest often draws photographers and birdwatchers daily. CPW acknowledges that the nest is located in an urban area with high human activity and the osprey seem unaffected by the disturbance around them. This is not surprising since some osprey do seem to tolerate human activity more so than other species of raptor. Based on this, CPW has little concern associated with the Prospect Sports project and does not feel any temporal or spatial restrictions should be placed on the project due to the osprey nest.
