Carter Dial Companies 11506 Nicholas, Suite 200 Omaha, NE 68154 PROJECT DESCRIPTION: Request to replat the existing Harmony Village Shopping Center for the purpose of adjusting the internal lot lines to accommodate the building layouts of the final users. The two most affected lots are Lots 11 and 12 which will be further divided into three lots. The new lots will be called Lots 11A, 1113 and 12A. Also, the replat allows the granting on new utility and access easements and vacating those utility and access easements that are found to be unnecessary. The perimeter boundary of the shopping center will not change. RECOMMENDATION: Approval EXECUTIVE SUMMARY: The request to replat the Harmony Village P.U.D. is in compliance with the plat standards of Section 3.3.1 of the Land Use Code. There are no impacts on surrounding property owners as a result of the creating one additional lot. The replat is accompanied by two Minor Amendments so that the P.U.D. is kept up to date to reflect the changes. COMMUNITY PLANNING AND ENVIRONMENTAL SERVICES 281 N. College Ave. P.O. Box 580 Fort Collins, CO 80522-0580 (970) 221-6750 PLANNING DEPARTMENT Harmony Village P.U.D., Replat Number One, #65-93E June 2, 2000 Administrative Hearing Page 2 COMMENTS: Background: The surrounding zoning and land uses are as follows: N: H-C; Old Harmony Store and Miscellaneous Business Services S: R-L; Existing Single Family Residential (Harmony Crossing P.U.D.) E: H-C; Poudre Valley Hospital, South Campus W: H-C; Miscellaneous Wholesale and Industrial Uses The property was annexed in 1989. In 1993, the parcel was included in the 74-acre Harmony Crossing Overall Development Plan. Also in 1993, the Harmony Crossing Final P.U.D. was approved which allowed 221 single family detached homes on 41 acres for a density of 5.4 dwelling units per acre. Harmony Village Preliminary P.U.D. was approved in November of 1998 and the Final was approved in February of 1999. 2. Plat Standards: The Replat has been reviewed against the criteria of the Plat Standards under Article Three, Division Three of the Land Use Code. The request to divide the parcel into two lots satisfies the following standards: A. Section 3.3.1 (B) (1) - "Lots" This criterion requires that lot sizes shall exceed the required minimum size specified in the applicable zone district. The subject parcel is in the H-C, Harmony Corridor zone district. Since there are no minimum lot sizes specified in this zone, the proposed lots comply. B. Section 3.3.1 (B) (2) - "Lots" This criterion requires that the general layout of lots, roads, driveways, utilities, drainage facilities and other services within the proposed development shall be designed in a way that enhances an interconnected street system within and between neighborhoods, preserves natural areas and features, and otherwise accomplishes the purposes and intent of the Land Use Code. Each of the new lots have frontage on a public or private street which connects the site to the existing general layout of roads in the surrounding neighborhood and the city at -large. C. Section 3.3.1 [C] (1) - "Public Sites, Reservations and Dedications" This criterion requires that a subdivision dedicate rights -of -way for public streets, drainage easements and utility easements as needed to serve the area being platted. The proposed Replat satisfies this criterion by dedicating the necessary land needed for public utilities and access. Additional street right-of-way is not needed. 3. Findings of Fact: In reviewing the request for Harmony Village P.U.D., First Replat, Staff makes the following findings of fact: A. The request complies with the applicable Plat Standards of the Land Use Code. B. The request complies with the land development standards of the H-C, Harmony Corridor zone district. C. Since there is no request for new land development or new construction, other engineering standards in the Land Use Code do not apply. D. The appropriate Minor Amendments have been submitted and approved to coordinate the changes as a result of this Replat with the approved P.U.D.
