College Ave #410 Ft. Collins, CO 80524 RE: Montava Phase D - Commitment to Serve Dear Forrest, The Boxelder Sanitation District (District) has reviewed your request of March 27, 2024, asking for a commitment to serve the above referenced property with sanitary sewer service. The property is within the District boundary. Feasibility may include but not limited to physical, practical and fiscal consideration; as well as, regulatory and police powers measures of the government which may affect the District’s ability to serve the project. The District is committing to provide sewer service for the connection subject to the following conditions: • Payment of all current fees including plan review fees. No plans will be reviewed without these fees being paid. Attached is the Development Application which needs to be completed and sent along with the review fees. • Dedication of easements necessary for sanitary sewer service within and through the property as needed to provide service to the property and other properties surrounding it. • Negotiate and sign any and all contracts that will need to be put into place for the project. • Payment of construction inspection and system development charges for individual service connects to be served by the District. • Compliance with all District Policies, Rules and Regulations, and Standards and Specifications, which are subject to future actions from the District governing board. This includes compliance with the Industrial Pretreatment Program for non-residential properties, and once plans have been submitted for review it will be determined by our Pretreatment staff if a grease/oil/grit trap will be required. The District administers design standards for the sewage collection system construction, will provide review of the design drawings, and requires payment of plan review fees prior to the design review. Compliance with those standards will meet or exceed the level of service requirements outlined in Section 4.3.5 of the Larimer County Land Use Code (should that code be applicable). In addition, the District is in compliance with all federal and state water quality treatment, capacity and discharge requirements. This conditional commitment to provide sewer service to the property is valid for two (2) years from the date of this letter. After that period of time the project would need to be re-evaluated on the District’s commitment to provide sewer service. Sincerely, Brian Zick District Manager Montava Phase D
