What hardship prevents this site from meeting the requirement?
The proposed site is a 3.16-acre infill development with an existing regional detention facility in place.
Historically the on-site pond acts as the regional detention pond for itself as well as 3.82 acres of offsite
property with no water treatment volume. This includes 5 adjacent commercial and residential parcels as
well as public and shared private roads, which is more than double the area of the proposed site.
Underground chambers will replace the existing detention facility and because the regional pond was
designed from previous regulations, the new redevelopment requires an increase in detention and water
quality treatment (LID/WQ) volume. The sizing of the new detention area will have to take into account the
increased detention and 100% LID/WQ volume required from not just the proposed site, but all adjacent
parcels and roads that impact the site as well.
What alternative is proposed for the site?
This project proposes to treat 100% of the contributing drainage basin including offsite parcels and public
and private roads via underground StormTech Isolator Rows. Detention will be provided by the StormTech
chambers and aggregate void space within the system. The alternative requested is to Chapter 7.4 &
Chapter 6.4.1 for the LID/WQCV to also be included within the 100-yr detention volume. This requested
alternative addresses the hardship of providing regional detention and water treatment for offsite lots and
public infrastructure on this privately owned urban infill site.

The owner agrees to comply with the provisions of the zoning ordinance, building code and all other
applicable sections of the City Code, Land Use Code, City Plan and all other laws and ordinances
affecting the construction and occupancy of the proposed building that are not directly approved by
this variance. The owner understands that if this variance is approved, the structure and its occupants
may be more susceptible to fl ood or runoff damage as well as other adverse drainage issues.
