l;ath Annexation and the Pine Ridge Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
As adopted in 1980, the Intergovernmental Agreement for the Fort Collins
Urban Growth Area �rovides Y.hat the City of Fort Collins will annex all
eligible property within the Urban Growth Area. The annexation laws of the
State of Colorado allow a municipality to annex county enclaves which have
been completely surrounded by the city for three or more years. There are
a number of properties throughout the city that qualify for annexation
under these terms.
At the request of the City Council, staff has been processing the
annexation of county enclaves as they become eligible under State law.
These two annexations were approved by the Planning and Zoning Board on
February 23, 1987, each by a vote of 7- 0.
BACKGROUND:
Two properties are included in this resolution of intent to annex.
Following adoption of this resolution by Council and after appropriate
notification of affected property owners, the annexation and zoning
requests will be considered on first reading at.the April 21st Council
meeting.
The two properties include:
1. Bath Annexation: 8.09 acres, corner of Prospect Road and Timberline
Road.
2. Pine Ridge Annexation: 5.85 acres, east of Lemay Avenue one mile south
of Narmony Road.

RESOLUTION 87-39
OF THE COUNCIL OF THE CITY OF FORT COLLINS
SETTING FORTH THE INTENT OF THE CITY OF FORT COLLINS
TO ANNEX THE CERTAIN AREAS TO THE CITY
WHEREAS, the properties hereinafter described have, hereinafter for
more than three (3) years prior to the date of this date, been completely
contained within the boundaries of the City of Fort Collins; and
WHEREAS, the Council of the City of Fort Collins has determined that
it is in the best interests of the citizens of the City of Fort Collins ta
annex said areas to the City, as required by the terms of the
Intergovernmental Agreement between the City and Larimer County, Colorado,
dated August 3, 1983.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council of the City of Fort Collins hereby sets
forth its intent to annex the following described properties situate in the
County of Larimer, State of Colorado, to wit:
BATH ANNEXATION
� A tract of 1 and 1 ocated i n the SE 1/4 of Secti on 18, Townsh i p 7
North, Range 68 West of the 6th P.M., County of Larimer, State of
Colorado, which considering the South line of the SE 1/4 of
Section 18 as bearing N 89°09'00" E and all bearings contained
herein relative thereto: Commencing at the SE corner of said
Section 18; thence S 89°09'00" W 100.00 feet to the True Point of
Beginning; thence N 00°00'00" W 759.00 feet; thence S 88°59'57" W
133.95 feet; thence S 89°08'06" W 455.27 feet to a point of the
East R.O.W. line of the Colorado and Southern R.R.; thence along
said R.O.W. S 18°14'36" E 574.86 feet to a Point of Tangent of a
spiral curve; thence along said R.O.W. and on a spiral curve to
the left with a delta of O1°30' whose chord bears 18°44'27" E
148.72 feet to a point of tangent of a spiral curve; thence along
said R.O.W. and on a spiral curve to the left with a delta of O1°
28'36" whose chord bears S 20°28'51" E 72.55 feet to a point on
the South line of the SE 1/4 of said Section 18; thence along the
South line of the SE 1/4 of said Section 18 N 89°09'00" E 336.06
feet to the True Point of Beginning.
The above described tract of land contains 8.09 acres more or
less.
PINE RIDGE ANNEXATION
A tract of land located in the SW 1/4 of Section 6, Township 6
North, Range 68 West of the 6th P.M., County of Larimer, State of
Colorado, being more particularly described as follows:
• Considering the West line of the SW 1/4 of Section 6 as bearing N
00°03'20" E and with all bearings contained herein relative

thereto: Commencing at the SW corner of said Section 6; thence •
along the said West line North 00°03'20" East 727.59 feet to the
True Point of Beginning. Thence continuing along the said West
line, N 00°03'20" East 474.13 feet; thence S 83°17'50" East
641.37 feet; thence South 00°03'20" East 399,89 feet; thence
North 89° 56'40" West 637.06 feet to the True Point of Beginning.
The above described parcel contains 5.85 acres more or less and
subject to all easements and rights-of-way now existing, or of
record.
Section 2. That the notices attached hereto be adopted as a part of
this resolution. Said notices establish the date, time and place when a
public hearing will be held regarding the passage of an annexation
ordinances pertaining to the above described properties. The City Clerk is
directed to publish a copy of this resolution and said notice as provided
in C.R.S., 31-12-108(2).
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 17th day of March, A.D. 1987.

PLEASE TAKE NOTICE that the Council of the City of Fort Collins has
adopted a resolution of intent to annex the area known as the Bath
Annexation more particularly described in said resolution, a copy of which
precedes this notice.
THAT for more than three (3) years more than two-thirds (2/3) of the
boundary of said territory has been contiguous with the boundary of the
City of Fort Collins.
THAT on April 21, 1987, at the hour of 6:30 p.m. or as soon thereafter
as the matter may come up for hearing before the City Council in the
Council Chambers in the City Hall of the City of Fort Collins at 300
Laporte Avenue, Fort Collins, Colorado, the City Council will hold a
hearing upon said resolution for the purpose of determining and finding
whether said territory proposed to be annexed meets the applicable
requirements of Colorado law and is eligible for annexation. At such
hearing, any person living within the area proposed to be annexed and any
landowner of lands therein, and any resident of the City of Fort Collins,
and all other interested persons may appear and present such evidence as
they may desire.
